Dealing with an increasing number of school demands that athletes pay liquidated damages if they transfer, even after the seasons for which they were paid have concluded. What’s the school’s protectable interest if the athletes are not employees? Their NIL value under the fake licensing agreement? Ludicrous. Still no decision in Sorsby. Arbitrations happening elsewhere.

As of today, we have already surpassed our entire 2025 revenue. And 2025 was a strong year. It didn't come from 1 deal. It came from the unglamorous work. Emails, drafts, negotiations, and protecting the quality of what we deliver. Grateful to our clients! linkedin.com/posts/sportsage…

Proud to represent Clemson women's basketball player @miavmoore28 as she fights for eligibility. The NCAA denied her waiver based on a roughly 1-minute appearance made while recovering from a documented ulnar nerve injury, after she had told her trainer that she didn't feel ready to play. We are preparing to seek a temporary restraining order and an injunction to get her back on the court this season. I'm working with @peplawchs as local counsel.

Justice for Victory Vaka! Rutherford County Chancery Court just granted our temporary injunction against the NCAA. The NCAA is ordered to certify him as eligible within 24 hours and immediately permit his entry into the transfer portal. The court also enjoined the NCAA's "Ghost Transfer" rules and "Rule of Restitution" penalties designed to punish athletes for winning in court. No bond required. Here's the order: heitnerlegal.com/wp-content/…
The hearing in Victory Vaka v. NCAA went very well. The judge is aware of the enrollment deadlines and indicated that a decision should be issued by the end of the week. For insight into what went down in the courtroom: teapawt.net/jaybjackson/status/208…

Update: The judge issued an Order denying the NCAA's motion to reconsider the injunction in Tristan Smith v. NCAA. He remains eligible to play for Clemson.
Big win for our client, Tristan Smith. A South Carolina court just granted a temporary injunction against the NCAA, restoring his eligibility to compete for Clemson this fall. The NCAA's arbitrary application of its Five-Year Rule didn't hold up. Justice for Tristan! heitnerlegal.com/wp-content/…

Our Verified Complaint and request for immediate relief on behalf of Victory Vaka were filed today. We hope the Court grants temporary relief so Victory can suit up for a new team as soon as possible.
We have given the NCAA every opportunity to resolve the Victory Vaka matter before filing suit. Since being retained, we have reached out to the NCAA almost daily in a genuine effort to avoid litigation. Unfortunately, we have no option but to escalate and will be filing this week (and as soon as today). The NCAA had nothing to fear about copycat lawsuits. The facts here are unique, and a resolution would not have opened the floodgates. The NCAA could have done the right thing. It didn't, and now we will be suing.

It would be very simple for the NCAA to do the right thing for once and reconsider Victory Vaka's legislative relief waiver. Victory didn't "fail to report." He went home to grieve his mother, who died unexpectedly. Western Kentucky acted with malice, and Victory should suffer? Is this really the next case that the NCAA wants to defend? Because we are bringing an action unless the NCAA suddenly gains a conscience and allows Victory to move on to a school that wants him on its roster.

Thank you @PabloTorre for bringing light to this important piece of evidence. Terry Rozier is innocent and has excellent new defense counsel @domarkus. I personally look forward to working with the NBPA to obtain the economic relief Terry deserves.
NEW: Terry Rozier argues this unearthed text message should "end the case" in his NBA gambling saga... "Dont tell [Rozier] bout the bet" @PabloTorre asks: What did Scary Terry know? And when — if at all — did he know it?

Today's order speaks for itself. Kashie Natt is back with Oklahoma State. Full team activities, roster status, and competition, effective immediately. The NCAA is enjoined from enforcing its June 24 cancellations, from threatening Oklahoma State with sanctions for complying, and from enforcing the Rule of Restitution. Expedited hearing on permanent relief to follow. heitnerlegal.com/wp-content/…
Oklahoma State guard Kashie Natt is permitted to immediately resume and continue full team activities with the Cowboys’ basketball program, according to an ex parte order signed by judge, his attorney @heitner tells @On3.

Many courts have sided with athletes in identical circumstances in the recent past, including in the case in which I represent Tristan Smith. @HEITNERLEGAL is proud to represent Dean Miller in his effort to secure eligibility to compete for the University of Central Florida in the 2026 season. We will advocate vigorously on his behalf.
Another NCAA eligibility suit filed: Former Kansas and current UCF DE Dean Miller is seeking an additional year of eligibility arguing that his JUCO season (a la Diego Pavia) should not count. NCAA denied his waiver, potentially costing him $300,000 - what he’s set to earn at UCF

We gave it our all for Tristan Smith. The NCAA gave everyone in Diego Pavia’s class an extra year, not counting 1 year of JUCO. To not give all former JUCO players an extra year of eligibility would be arbitrary and capricious. We hope the judge agrees. Will find out this week.
