ECI tells the Supreme Court that suggestions, observations or queries by its own members are NOT decisions of the Commission.
In its counter affidavit in Rakesh Kumar Singh v. Union of India, the ECI says "any suggestion, observation or query by the Chief Election Commissioner or the Election Commissioners … does not constitute a decision of the Election Commission under Section 18 of the 2023 Act."
