Yes, Armed Civilians Can — and Do — Stop Mass Shootings: Data ignored by the FBI show the importance of defensive gun use in bringing down active shooters Two days after last week’s attack on an Oregon elementary school, the @AP opened a news story with a familiar claim: “Few mass shootings in the U.S. end like the deadly attack on an Oregon elementary school: with an armed civilian opening fire on the gunman.” crimeresearch.org/2026/10/at… #2a #guns #GFZ #gunfreezone

As much as we may disagree with and often dislike our antigun opponents, one thing we never try to do is silence them. Hell, we want them to speak more, because it exposes the evil and idiocy underpinning their policy preferences and ideology. Sadly, they almost never directly engage with us in a substantive way (probably a smart choice on their part). Their strategy is entirely different. Everytown & friends constantly try to silence us. This attack on the free speech of guntubers is just the latest example. They also sue gun companies for their marketing even when they have zero evidence a crime suspect even saw the advertising in question (let alone evidence that the ad caused them to do the crime). The point isn't that such frivolous litigation would win, it's to use daddy Bloomberg's wallet to bury companies in litigation expense. They also tried to block our access to the courts in California in 2022, backing SB 1327 which would have made gun rights litigants responsible for the State's legal fees if we sued and lost on any claim. For example, suppose we sued California over reciprocity, making both a Second Amendment argument, but also a secondary right to travel argument. Then suppose we win on 2A, but the court isn't convinced on our right to travel cause of action. Huge win right? Nope, under SB 1327, we'd have to pay all of the State's legal expenses because we didn't technically win *every* claim. The law was blatantly unconstitutional for violating the right to petition the courts for redress of grievances, Bonta refused to defend it. Newsom's own lawyers came in to defend it, and we crushed them. Easiest court win I will ever be a part of. Newsom didn't even appeal when Judge Benitez struck it down. But you know who did back that obviously tyrannical law? The scum at Everytown, as well as Moms Demand Action and Students Demand Action (which are also Everytown). So this isn't new for them. They see silencing us as a legitimate vector of attack. And pressuring Youtube to deplatform guntubers is just another part of that strategy.
As expected, here's the new Everytown article complaining about "how the firearms industry supports 'guntubers' who endanger public safety" smokinggun.org/report/loaded…

Re Joe DiGenova. Reading between the lines from multiple "in the know" comments/sources here. Resignation abrupt. Supposed complaints about progress and pace, and questions about what's taking so long. Comments about "rabbit holes" and unproductive efforts. Reports earlier this week of more GJ Subs having gone out -- if you're still sending out Subs that are going to take 60 days to turn around, then you're not close to indicting. DiGenova comments about "charges without evidence" and ethical problems. Now John Solomon references common DOJ disputes over access to resources. My surmise -- WH and DOJ expected DiGenova to move the investigation into "end game," i.e., move from evidence gathering to indictments and trials. But now they see him wanting to go down other roads of inquiry. He wants more personnel and money, and DOJ suggests if won't be forthcoming unless he puts something on the table. WH to DOJ -- "Why is nothing happening in FL?" DOJ To Joe -- "What are you waiting for? How much longer." Joe to DOJ -- "We don't have what we need yet, we need to continue digging for evidence. I need more money and manpower. DOJ to Joe -- "That's unlikely unless you show some actual progress in a public way." Joe to DOJ -- "I'm not indicting people just to make the WH happy." DOJ to Joe -- "That's what they expected when they hired you." Joe to the World -- "I quit."

Replying to @VicToensing
Heavenly Father, We lift up Victoria Toensing, Joe DiGenova, and their family to You tonight. In this, what feels to us as, a sudden turning of the page, we ask first for their peace. Guard their health, their rest, and their hearts. Give Joe strength and clarity, and give Victoria the same steadiness she has so often given others. Keep their home quiet when the news and noise gets loud. Grant them grace & rest. Where there may be uncertainty, grant them wisdom and a soft landing. Surround them with people who love them for who they are and for the work they have done. Bless their family with unity, kindness, and protection. Let no rumor, pressure, or bitterness steal their peace from one another. Restore what public life has taken, and keep what is private truly private. We pray they would know they are more than a headline to us. We love them. Watch over them this night and in the days ahead. Give them health, dignity, and a gentle path forward. Amen. 🙏❤️

⚖️ PLANETHANK WINS IN FEDERAL COURT 🏆 Vermont Attorney General Charity Clark tried to silence my political satire. Instead, a federal judge blocked her investigation, called the video “ridiculous,” and questioned why the state pursued it in the first place. They expected me to delete the video and quietly back down. I took them to federal court—and won the preliminary injunction. Rough week for Vermont’s radical left: their activist was held on drug-trafficking charges, their clergy were carried away by police, and their Attorney General got carried out of federal court by the First Amendment. 🤷🏼‍♂️ Turns out the Constitution also protects controversial Brattleboro men. #FirstAmendment #FreeSpeech #Vermont #VTDrops #PlanetHank

New amicus brief filed by Second Amendment Law Center, written by the great Stephen Halbrook. The author ensures this brief is one the Court will pay attention to. The brief argues that the AR-15 is the current form of a long-established category of commonly owned semiautomatic rifles, and banning it is inconsistent with the historical tradition of the right to keep effective arms. "The AR-15 falls within the historical tradition of the right to effective arms for defense of self and state and other lawful purposes. The English freeman had a right and duty to be armed. From colonial times to the Revolution and beyond, effective arms were critical to the Americans. In reaction to arms confiscation by the British, the colonists asserted their right to keep and use their militia arms in defense of liberty. The Second Amendment was understood to guarantee a robust concept of the “Arms” that the people have a right to keep and bear."

Florida just handed you four months of tax-free guns and ammo. Starts tomorrow. September 1 through December 31. No price cap. None. Buy the rifle. Buy the cases of ammo. Buy the optics and the slings. The state is not taking a dime. Tents and fishing rods have limits. Firearms and ammunition do not. DeSantis signed it. The legislature passed it. Now it is your turn to use it. This is what a Second Amendment state looks like. Stock up. The clock runs out on New Year’s Eve.

In 2001 George W Bush proposed a partial privatization plan for Social Security so you could put 10% of your SS contribution into the markets. People rejected this. We can now see that if it had passed, the 10% that went into the markets would have outperformed the 90% the government managed, the program would be solvent, and the average SS recipient would be receiving 2X what they currently receive. The worst bet you’ll ever make is betting on government.

This article is exactly why Judge Freeman joining the majority and writing its opinion was an act of judicial courage. It shouldn't be brave to reach the correct (and simple) decision; but it is. By being faithful to the Second Amendment and SCOTUS precedent, she basically torched any chance she had of ever making it to SCOTUS herself. She is otherwise the right age (48) for it, and also had the Dem's obsession with identity politics on her side too, being a black woman. If the next President is a Dem and there is a SCOTUS vacancy, she would have been a strong contender. Not anymore. After this, no way antigun groups and rags like SLATE ever allow her to be nominated.

I forgot to mention that I recently hit my one year mark with Second Amendment Foundation! And what an excellent year it has been! Maybe my most productive ever given the total 2A focus SAF has allowed me to have. - 18 amicus briefs that I personally drafted, not counting some others we joined primarily drafted by others that I helped edit. - Probably like a hundred interviews to promote our work - Dozens of articles - More twitter threads than I can remember analyzing rulings or briefs - Getting back into direct handling of litigation with SAF v. Contra Costa recently (may have pleasant news on that one soon by the way - we'll see) - Shot Show was amazing! Always wanted to go and finally did. - Helped Alan Beck coordinate amicus brief and prepare for oral argument in Wolford. - Wrote some comment letters (more coming very soon for ATF rulemaking) - Working with the very best team in this space, by far. And I'm not just saying that because I am there, though obviously, I am very important and kind of a big deal. /s. I'm probably forgetting a ton more. It's been excellent, and I hope the years to come will be just as productive.

The Outlook recall function is the greatest psychological weapon in modern legal practice. At 11 PM on a Sunday, I drafted an email to a junior associate. The subject line simply read, "Regarding your future at the firm." I left the body of the email completely blank and hit send. Exactly 12 seconds later, I recalled the message. I knew he had notifications pushed to his phone. I knew he saw the subject line pop up on his lock screen. And I knew the message would vanish before he could open it. He showed up at my office at 7 AM the next morning looking like he'd aged a decade. He begged me to tell him what he did wrong. I looked at him confused and asked for an update on the KYC deliverables. I never mentioned the email. He'll spend the next 6 months working with the desperation of a condemned man. All according to plan.

I left Alabama. I am in Georgia now. At 3 a.m. I saw a yellow sign glowing beside the highway. Waffle House. I went in. The parking lot was full. At 3 a.m. I asked the waitress when they close. She looked at me the way you look at a child who has asked when gravity ends. She said, "We don't close, baby." Two things happened in that sentence. One: I learned Waffle House has never closed. Not at night. Not on Christmas. Not during hurricanes. Two: she called me "baby." I am a grown man. I have a mortgage. It repaired something in me I did not know was broken. I ordered hash browns. She said, "Scattered, smothered, covered, chunked, diced, peppered, capped, or topped?" I did not understand a single word in that sentence. I said, "Yes." She nodded and wrote it down. Apparently that was a correct answer. Then I learned something, and I need you to know I did not invent this. The United States government measures the strength of hurricanes by whether the Waffle House is open. Open: the storm is fine. Limited menu: the storm is serious. Closed: evacuate. It is over. This is called the Waffle House Index. FEMA uses it. FEMA. The disaster agency. Japan built earthquake satellites. America watches a diner. Both systems work. At 3 a.m., the Waffle House contained: two truck drivers. A nurse still in scrubs. Four teenagers in prom clothes. One man who had clearly made several mistakes that evening. And one Japanese man with a notebook. Nobody asked anybody why they were there. At Waffle House, being there is the answer. Then a man at the counter noticed my Alabama shirt. It was a gift. Long story. He did not speak. He pointed at the shirt and shook his head slowly, the way you correct someone in church. Then he said, quietly: "Go Dawgs." I panicked and used the only word I own. "Roll Tide." Every fork in the building stopped. The cook looked up from the eggs. The waitress said, "Baby, no." I understand now. Every state here has its own word. My word is from one state ago. The man bought my waffle anyway. He said, and I am quoting him exactly: "You didn't know. Bless your heart." I have been told that phrase has two meanings. I believe I received the gentle one. I believe.
In Alabama a man said "Roll Tide" to me as a greeting. Later that same day, the same man said "Roll Tide" as a goodbye. I asked a woman at the store what it means. She said, "Roll Tide." I asked what it means. She said, "It means Roll Tide, sugar." So I began collecting evidence. I kept a list. I am not embarrassed about the list. I have now heard "Roll Tide" used as: hello. Goodbye. Thank you. I am sorry. Congratulations. That is unfortunate. I agree. I disagree. And once, in a hardware store, as a complete set of instructions for installing a ceiling fan. I heard it said at a funeral. It was appropriate. It was the most appropriate thing anyone said that day. I began using it. Carefully at first, the way a man handles a borrowed sword. I said it to a cashier. She said it back. I said it to a police officer who had stopped me for a broken taillight. He looked at me for a long moment. He looked at my face. He looked at my taillight. Then he said it back, and nodded once, and did not write the ticket. I wish to be extremely clear that I am not claiming those two events are related. I am also not claiming they are unrelated. A man at a gas station heard my accent and asked where I was from. I told him Japan. He said, "Roll Tide." He meant welcome. I knew he meant welcome. There was no ambiguity at all. I have been in Alabama eleven days. I have one word. It has been enough for everything. I have started saying it in other states. It does not work in other states. I said it in a warehouse store in Oregon. One man turned around. He was from Alabama. He said it back. We did not speak after that. We did not have to. I say it anyway.
