What to know if you lost money on Drift -- Attorney Advertising -- There is a class action involving the Drift hack. Here is what it does for you, what it does not, and what nobody has told you to do. This is for anyone who had assets on Drift on April 1, 2026, or who held DRIFT tokens, wherever you live. THE CLASS ACTION In April 2026, a law firm filed a proposed class action against Circle, the issuer of USDC. The complaint alleges that Circle failed to freeze stolen funds after the Drift incident when it had the ability to do so. Many Drift users have heard about it and assume they are covered. Here is what it is. It is a lawsuit against Circle. If a class is certified and you fall within it, you are a class member automatically unless you opt out. You do not choose the lawyers, the claims, the strategy, or the terms of any settlement. You may hear nothing for a long time. Here is what it is not. It is not a lawsuit against Drift Labs, the Drift Foundation, or Drift's founders. It does not pursue your claims against the people who ran the platform where your money was. If you want those claims pursued, that is a separate matter, and it happens only if you make it happen. What the class action means for you personally is a question a lawyer can answer from your facts. YOU MAY HAVE A CLAIM AGAINST THE PEOPLE WHO RAN DRIFT A loss on a platform is not only a loss. It may also be a legal claim against the platform's operators. Whether you have one depends on your facts. Where you were. What you held. What you were told. What you lost. Most people never find out, because no one tells them to ask. THE RECOVERY TOKEN Drift's recovery token, DFX, opened for claims and redemption on October 1, 2026. To claim, you accept Drift's terms and approve a wallet transaction. Interacting with that token may affect your legal claims. Claiming it means accepting Drift's terms. Redeeming it means accepting a payment from Drift, at a price determined by Drift's own formula, in a transaction that is final. Transferring it, or agreeing to anything connected to it, may matter as well. We are not telling you what to do with the token. We are telling you to find out what it may mean for you before you do anything with it. DEADLINES Legal claims against Drift are subject to statutes of limitations. How long you have depends on where you live and on the type of claim, and some periods are shorter than people expect. A lawsuit against Circle does not necessarily protect your claims against anyone else. Drift's own program has its own deadline. The entities involved are changing shape: Drift relaunched under a new name, Velocity, in July 2026, and has raised new financing. None of this means you have to act today. It means you should know where you stand. WHAT TO DO THIS WEEK You can see your verified loss at dfxdotdriftdottrade without claiming anything. Connect the wallet you used with Drift and screenshot that page. Save everything: your wallet addresses, your transaction history, emails from Drift, Discord and Telegram messages, and screenshots of anything Drift told you about safety, custody, or control of the protocol. Do not accept terms, claim, redeem, transfer, or sign anything connected to DFX until you understand what it may mean for your claims. If you want to know whether you have an individual claim against Drift and where it stands, email us at [email protected]. The review is free and confidential, and there is no obligation. Burwick Law's RICO Claims Against Pumpfun Survive Motion to Dismiss Burwick Law's civil RICO claims on behalf of two clients against the crypto memecoin platform Pumpfun and its co-founders have survived the defendants' motions to dismiss. On August 31, 2026, Judge Colleen McMahon of the Southern District of New York held in Aguilar v. Baton Corporation Ltd. that the complaint adequately alleges a racketeering enterprise, wire fraud based on Pumpfun's "fair launch" marketing, and operation of an unlicensed money transmitting business, and that the England-based platform and its founders can be sued in federal court in New York. The defendants were represented by Cahill Gordon & Reindel and Brown Rudnick. The court dismissed the lawsuit's other claims, including those against the Solana defendants, but the RICO claims now proceed against Baton Corporation Ltd., Alon Cohen, Dylan Kerler, and Noah Tweedale on behalf of a proposed class of retail traders who the complaint alleges collectively lost between $4 billion and $5.5 billion on Pumpfun tokens. This may be considered attorney advertising in some jurisdictions. Prior results do not guarantee a similar outcome.

$254,562 lawsuit filed in New York against Polymarket over the 'MicroStrategy sells any Bitcoin by May 31' market. The complaint alleges Polymarket rewrote the market's resolution rules after Strategy's own SEC filing confirmed the sale. Attorney advertising.

Read the as-filed Preliminary Statement here: 1. Strategy Inc. (NASDAQ: MSTR) is the largest corporate holder of Bitcoin in the world, famous for one vow: never sell. Between May 26 and May 31, 2026, it sold. 2. Polymarket had asked traders: will Strategy sell any Bitcoin by May 31, 2026? After Strategy sold, Polymarket decided the answer was “No.” 3. Polymarket operates what it calls the world’s largest prediction market with “[f]air & transparent markets, by design.” 4. It sells rules-based resolution and answers: markets “resolved according to the market’s pre-defined rules,” where the posted rule “define[s] how [the market] should be resolved.” 5. It advertises that its technology finds truth: that “[m]arkets seek truth,” that its prices reflect “accurate, unbiased, and real-time probabilities,” and that people use Polymarket “for the most accurate odds.” 6. Its business is the wisdom of crowds: collective knowledge in, truth out. Thousands stake money on a question; the market aggregates their choices into a probability/price between zero and one dollar; and when the answer arrives, everyone who was right is paid $1.00 per share. 7. But the advertised value holds only if the last step is honest. None of it matters if the answer key is wrong. Resolution is the step where a prediction market either tells the truth or does not. This case is about a resolution that did not tell the truth. 8. The market at issue asked one binary question: would Strategy sell any of its Bitcoin by May 31, 2026? 9. The “pre-defined” rule was plain. The market would resolve “Yes” if MicroStrategy sold any of its Bitcoin by 11:59 p.m. ET on May 31, and otherwise “No.” 10. The rule made the sale the event. It did not require that the sale be announced by the deadline, only that it happen by the deadline. It was a question about the world, not the news cycle. 11. The rule named its resolution source: “information from MSTR,” the company that reported its Bitcoin activity in SEC Form 8-Ks on Monday mornings. With May 31 falling on a Sunday, the authoritative answer would arrive Monday, June 1. 12. The never-seller sold. On the morning of June 1, Strategy’s own SEC filing reported 32 Bitcoin sold, “as of May 31, 2026, 4:00 p.m.” 13. The most authoritative proof of the fact, the very “information from MSTR” the rule named as a primary source, arrived. Per the rule, the question’s answer was “Yes.” 14. Polymarket rewrote the rule instead. At 1:00 p.m. that Monday, after heavy trading on the morning’s filing, it posted that “[c]onfirmation achieved outside of the market’s time frame does not qualify.” 15. That changed the question from whether Strategy sold by May 31 into whether the sale was confirmed by May 31. “Yes” collapsed within minutes. 16. Mr. Dong had read the rule as written and took Polymarket at its word. He held approximately 255,051 “Yes” shares worth approximately $255,051 at the promised $1.00 a share. After the 1:00 p.m. rewrite, he salvaged approximately $490. 17. The loss poses a question larger than one trade. A technology marketed as the most accurate truth finder in the world returned an answer that its own written rule, its own designated resolution source, and the issuer’s own SEC filing all contradict. 18. Either the technology does not do what Polymarket advertises, or the people who run it are able to override the wisdom of the crowd when their accuracy is unexpected. Both possibilities are irreconcilable with what Polymarket sells. 19. Mr. Dong brings this action for breach of contract, breach of the implied covenant of good faith and fair dealing, money had and received (in the alternative), and deceptive practices and false advertising under New York General Business Law (“GBL”) §§ 349 and 350. He seeks not less than approximately $254,562 in damages, plus restitution, statutory and treble damages, injunctive relief, interest, attorneys’ fees, and costs.

Did Polymarket treat you unfairly? Burwick Law is investigating potential claims on behalf of Polymarket traders who lost money and believe they were treated unfairly by the platform. The firm is seeking to speak with Polymarket users who experienced issues involving disputed market outcomes, allegedly changed rules, delayed or unclear market clarifications, refused payouts, unexpected account restrictions, trading problems, or other conduct that caused financial loss.   Burwick Law recently filed a lawsuit against Polymarket, alleging that the platform failed to honor a market outcome after users allegedly held the correct side of a prediction market. The complaint alleges that Polymarket advertised itself as a truth-seeking, rules-based prediction market where correct outcomes are paid, but then resolved the disputed market contrary to the event allegedly confirmed by the designated source.  Burwick Law is encouraging Polymarket traders to preserve screenshots, transaction records, wallet addresses, market links, emails, support tickets, and any records showing their position, purchase price, market rules, clarifications, and final resolution. Polymarket traders who lost money and believe they were wronged can contact: [email protected]. Attorney Advertising. Prior results do not guarantee future outcomes. Contacting the firm does not create an attorney-client relationship unless and until an engagement agreement is signed.

Federal Class Action Lawsuit Against Ben Pasternak, B24, Inc., and Believe Foundation on Behalf of Launchcoin, Pasternak, & Believe Token Buyers Filed Burwick Law has filed a class action lawsuit on behalf of Plaintiffs in the United States District Court for the Southern District of New York against Ben Pasternak, B24, Inc. (d/b/a Believe, f/d/b/a Clout), Believe Foundation Inc., and Does 1 through 10. Pasternak is the founder and CEO of Believe, a Solana-based token launchpad formerly known as Clout that allowed anyone to create and trade crypto tokens through a mobile app or web browser with no technical experience required. The complaint alleges violations of New York General Business Law §§ 349 and 350, the California Unfair Competition Law, the California False Advertising Law, negligent misrepresentation, and unjust enrichment. The lawsuit seeks damages, restitution, and other equitable relief on behalf of a nationwide class. According to the complaint, Defendants told buyers that Pasternak held "0 ownership" in the original token while allegedly maintaining insider control. Defendants then made at least twelve public promises of a "flywheel" buyback over five months that were never honored. On the day the buyback finally launched, Pasternak allegedly told buyers that "no individual or entity is getting coins for the next year at minimum" while approximately 40 million Foundation tokens had already been unlocked with no vesting restrictions. A forced October 2025 migration allegedly expanded total token supply by 33%, directed roughly 25% of the new tokens to insiders, and permanently destroyed the holdings of anyone who missed the two-week migration window. The Believe platform launched in January 2025 on the Solana blockchain under the name Clout, offering a mobile-accessible launchpad for meme tokens and creator-backed digital assets. The platform accepted credit card payments and required no crypto wallet or prior experience. Believe cycled through three tokens: PASTERNAK (January 2025), LAUNCHCOIN (April 2025), and BELIEVE (October 2025). According to the complaint, the platform allegedly processed over $6 billion in cumulative trading volume, generating an estimated $54 million in platform fees. LAUNCHCOIN reached an all-time high of $0.3647 on May 15, 2025, pushing its market cap above $240 million and the total Believe ecosystem market cap past $400 million. By the time of filing, the BELIEVE token had lost 99% of its value from its peak, with alleged investor losses estimated in the hundreds of millions of dollars. Burwick Law is a crypto litigation firm representing over 4,000 clients nationwide in digital asset fraud, token loss, and memecoin class action matters. The firm is founded and led by Max Burwick, a U.S. Navy veteran and rescue swimmer. Burwick Law currently serves as lead counsel in several of the highest-profile crypto lawsuits in the country, including the Hawk Tuah meme coin case and a RICO lawsuit against Solana, memecoin launchpad Pumpfun, and their respective officers alleging they operated as an unregistered securities platform and illegal casino.
