POLICY CHANGED: County Durham and Darlington NHS Foundation Trust has finally changed its staff changing-room policy after a three-year legal battle with the Darlington nurses in which female nurses were harassed and discriminated against for wanting a single-sex place to undress at work.
The Trust’s revised Uniform and Dress Code Policy now states:
“In accordance with UK Supreme Court ruling (2025), staff must use changing spaces according to their biological sex. Alternative unisex changing spaces are provided for staff who choose not to use an alternative facility.”
The change brings the Trust’s written policy into line with the law and the judgment secured by seven nurses at Darlington Memorial Hospital.

It has taken Labour far too long to ensure the law about single sex spaces is implemented in the NHS.
Not only is it the law, it’s common sense. NHS Trusts now need to protect women without any further delay.
@KemiBadenoch has been clear on the need for safe, single sex spaces in the NHS for years. Here is Kemi making her position clear in March 2022.
Under Kemi’s leadership, the @Conservatives will always stand up for the right of women and girls to feel safe.

Trans women will finally be banned from female wards in hospitals under new NHS guidance.
Hospitals have been told that wards, lavatories and changing rooms should be segregated by biological sex, not gender identity ⤵️

🚨 NHS England publishes new guidance putting biological reality at heart of patient accommodation and staff facilities
Bethany Hutchison, President of the Darlington Nursing Union, said:
“Biological sex is not an optional belief. It is a material reality and, following the Supreme Court’s judgment, it is the basis upon which sex must be understood in equality law. We therefore welcome this clear and necessary guidance from NHS England.
“The test now is whether NHS trusts will actually follow it. Too many NHS institutions have been ideologically captured on these issues, leaving frontline women to defend rights and protections that their employers should have upheld from the outset.
“The Darlington nurses should never have had to take their own employer to court to secure privacy, dignity and lawful single-sex facilities. Enforcement cannot continue to depend on the courage and personal sacrifice of individual nurses.
“NHS England, regulators and trust leaders must now ensure that every NHS policy is brought swiftly and lawfully into line with this guidance, the EHRC Code and the Supreme Court’s ruling. There must be clear oversight, meaningful accountability and consequences for trusts that refuse to comply."

"Imagine telling your daughter, sister, wife or mother that if she objects to undressing in front of a man at work, she is the one who must leave. That was our reality.”

Tory Party Conference. Proud that we are hosting Jennifer Melle, @DarlingtonUnion, @CConcern, and that our Party knows that men can’t become women and that gender ideology harms.

Today, David Hay KC, for the Royal College of Nursing, has attacked the evidence of Christian nurse, Jennifer Melle and said it should be completely ignored...It can never be a great look to attack the experiences of a single mum and front line NHS nurse who was racially abused, physically threatened, suspended for 10 months and investigated by the regulator twice for indirectly referring to a transgender paedophile as a man.
The Royal College of Nursing did nothing to help and told Jennifer to do a 'reflection'. They saw Jennifer as the problem then, and they still do now 👇🏻

And dismissing JM's evidence of being asked to do a reflection and doing so with incredulity and that it called into question her motivations. This is the most important part of JM's evidence, that RCN considered her the aggressor in the interaction despite being repeatedly

(1) BREAKING: Christian social worker seeks legal history in Court of Appeal fight against viewpoint discrimination
Tomorrow, a Christian social worker who won a landmark freedom of speech case at the Court of Appeal in 2019 will return to the same court in what is believed to be the first time an individual has fought two separate Court of Appeal cases arising from professional penalties imposed because of the expression of Christian beliefs.
Felix Ngole, who has been supported by the Christian Legal Centre since 2014, is a qualified social worker, will appear before the Court of Appeal from 10am on Monday 28 September, with the hearing continuing on Tuesday 29 September 2026. Felix will be able for interview from 9.00am and there will be a visual display from supporters outside the Royal Courts of Justice.
The hearing is the latest stage in a long-running legal battle after mental health charity Touchstone Leeds withdrew a conditional offer of employment when it discovered online reports of Mr Ngole’s Christian beliefs on marriage and sexuality.
The case, supported by the Christian Legal Centre, has major implications for freedom of belief in the workplace.
At its heart is a simple principle: no Christian, or indeed anybody, should lose a career or a job opportunity because of lawful beliefs expressed outside work.
