Wondering if your #cannabis promotion is compliant under the #CannabisAct? Check out this flowchart which @rachelcolic and I developed to help with decision-making (*does not constitute legal advice 🙂)
There is no one factor to blame for the saturation of #cannabis stores. I believe it is the result of a combination of lack of visibility, scarcity, exuberance and, of course, the pandemic. theglobeandmail.com/business…
Recently, we uncovered a large #restaurant #trademark squatting scheme involving a number of US restaurant brands. Here is @RB_magazine coverage of what’s been going on.

In a decision that should surprise no one, it turns out that selling #cannabis edibles under the #trademark "Skittles", with labelling that resembles the well-known candy constitutes #trademark infringement and depreciation of goodwill. lnkd.in/gVVKzkhJ
Hey #trademark Twitter - ever seen a longer description of goods and services than this application by Emoji Company? Covering the field for any and all conceivable sales of anything featuring the word "Emoji" ic.gc.ca/app/opic-cipo/trdmr…
I love being a #trademark lawyer. But trademark lawyers are, without a doubt, the biggest nerds of all the lawyers, and there’s not a close second place 🤓 #lawtwitter
#Cannabis ads on TV in certain states? Hard to see this getting passed as law in the US. Less likely to ever see this in Canada, at least not any time soon adage.com/article/marketing-…
US will be challenged by prohibition on promotions by parties without a licence to produce, sell or distribute #cannabis. Will have to rely more on their LP and retail partners than they may realize. Health Canada enforcement been inconsistent to date mjbizdaily.com/us-cannabis-c…
#Trademark squatters are scumbags, but this story is at least a little entertaining. And a good reminder to file applications for your trademarks before someone else does! avclub.com/nbc-sues-trademar…
Times have changed for #cannabis brands and #celebrities. I assumed marketing restrictions in Canada was a main reason for the failure of these brands to launch. Based on these stats from the US, though, maybe most people simply don't care? benzinga.com/markets/cannabi… via @Benzinga

I don't like to use Twitter to call out non-compliant #cannabis branding, but the new "Marley Natural Cannabis Lifestyle" store on Avenue Road is going to make it a lot harder for lawyers to convincingly tell clients what types of promotions and trademarks are prohibited by law.
Ah yes, the Canadian #cannabis industry is quite familiar with prohibitions on promoting cannabis by means of the depiction of a person...

CIPO #trademark examinations are faster when you use goods and services from their pre-approved list. Unfortunately, many #cannabis TM appns were filed before CIPO incl'd cannabis goods and services on their list, so many don't get the benefit of this expedited review
"Infused-beverage sales...amounted to...$31 million...That’s significantly short of the half-a-billion-dollar annual market predicted..." 😬.
