CLASS OF 2022 ELIGIBILITY UPDATE. FRIDAY, OCTOBER 9, 2026, MORNING EDITION
Six material developments moved across state dockets this morning, led by Utah guard Trey Campbell turning an emergency order into 17 live game points while major eligibility fights hang in the balance across New Mexico, Missouri, Ohio, and Indiana.
UTAH. JUDGE CORNISH ENTERS TRO AS TREY CAMPBELL SCORES 17 AGAINST UNLV
In the Utah Business and Chancery Court in Salt Lake County, Utah, Judge Rita M. Cornish entered a temporary restraining order on October 7, 2026, protecting Utah basketball guard Trey Campbell against NCAA eligibility enforcement and barring penalties against the University of Utah. The order shields Campbell from governing body sanctions and insulates the institution while proceedings move forward.
Utah Athletics reviewed the court order and immediately cleared Campbell for competition, allowing him to start against UNLV on the evening of October 7, 2026, score 17 points, and lead Utah to a 79-69 victory. Campbell represents a concrete example of state court relief translating immediately into live game competition rather than merely permission to practice.
NEW MEXICO. JUDGE ALLISON DEFERS PRELIMINARY INJUNCTION DECISION UNTIL NEXT WEEK
In the Second Judicial District Court in Bernalillo County, New Mexico, District Judge Joshua Allison heard preliminary injunction arguments on October 7, 2026, and entered an order on October 8, 2026, deferring his ruling until no earlier than October 13, 2026. The court took the matter under advisement following oral argument, leaving the legal fight unresolved over the weekend.
New Mexico football defensive end Brett Karhu and defensive back Azariah Levells remain fully eligible to practice and compete under their previously entered temporary restraining orders while the court deliberates. Their existing relief represents the controlling position before the bench, ensuring uninterrupted participation while awaiting formal disposition.
MISSOURI. JUDGE MCCARTHY EXTENDS TETTAMBLE RESTRAINING ORDER IN ST. LOUIS COUNTY
In the St. Louis County Circuit Court in St. Louis County, Missouri, Judge Thomas A. McCarthy entered an order on October 7, 2026, extending Tulsa tennis player Gus Tettamble's temporary restraining order for an additional seven days while considering his preliminary injunction motion. The extension preserves the status quo and shields Tettamble from NCAA enforcement while the court completes review of the briefing.
Tulsa men's tennis player Gus Tettamble remains cleared to practice and compete in Division I fall collegiate matches under active judicial protection while his preliminary injunction request remains pending. The extension keeps him on the court for Tulsa, though court protection does not resolve whether he receives a fifth season.
OHIO. BOROVICANIN INJUNCTION REMAINS VACATED AS SUPREME COURT REVIEW PENDS
In the Supreme Court of Ohio in Franklin County, Ohio, Chief Justice Sharon L. Kennedy set a strict deadline of October 8, 2026 at 3.00 PM Eastern Time for the NCAA to respond to an emergency stay motion seeking reinstatement of the trial court preliminary injunction. Through morning docket releases on October 9, 2026, the Supreme Court has entered no order restoring injunctive relief, leaving the October 2 First District Court of Appeals reversal operative.
Xavier forward Lazar Borovicanin and twenty-three co-plaintiff athletes remain unprotected following that appellate reversal, leaving them barred from competition unless the state Supreme Court acts. Until emergency relief enters, the affected programs cannot roster or play these athletes without exposing themselves to NCAA forfeiture rules.
INDIANA. JUDGE KROTHE DENIES TRIAL STAY WHILE APPELLATE DELIBERATIONS CONTINUE
In the Monroe County Circuit Court in Monroe County, Indiana, Special Judge Kara E. Krothe denied the NCAA's trial court stay request on October 5, 2026, leaving the dispute before the Indiana Court of Appeals where athlete response briefing closed October 8, 2026. No emergency appellate stay has been entered on the docket following that filing deadline, leaving the trial court injunction undisturbed.
Indiana defensive lineman Stephen Daley and approximately ninety-seven covered athletes retain full operative eligibility protection to practice and play under the active trial court preliminary injunction. Indiana and other covered programs continue to roster and compete these athletes while the Court of Appeals deliberates.
MISSOURI. JUDGE HARRIS SCHEDULES CJ GUNN HEARING ON PROFESSIONAL GAMES ISSUE
In the Boone County Circuit Court in Boone County, Missouri, Judge Jeff Harris entered an order scheduling an initial hearing for October 13, 2026 at 1.30 PM Central Time regarding a newly filed complaint by former Indiana and DePaul guard CJ Gunn seeking fifth-year eligibility at Missouri. The lawsuit introduces a professional participation complication regarding three games played for the Calgary Surge, with Gunn proposing in his pleading to repay 524 dollars and serve a three-game suspension.
Missouri guard CJ Gunn remains without temporary restraining order protection and ineligible for competition while awaiting the October 13 hearing. Because Gunn has not secured temporary judicial relief and his case carries unadjudicated professional play questions, he is not a clean four-seasons-in-four-years case and cannot be rostered for games.
The upcoming Ohio Supreme Court ruling on the Borovicanin emergency stay motion is the single next event to watch that could immediately shift national competition status.

I’m probably crazy to respond to you but here goes. I’m not looking for clients. As class counsel, I am part of the team that represents thousands of class of 22 D1 athletes certified by Judge Sweeney. Because the NCAA has dragged their feet providing class counsel with contact 1

Please email this directly to me with the subject line of D1 athlete statement to: [email protected]. And feel free to share this request widely. Many thanks. 3/3

I am privileged to be part of the legal team on the Colorado 5 in 5 eligibility case. I have resisted posting here because I prefer to litigate in the courts rather than social media. Given the disappointing albeit temporary ruling this past Friday, I have a favor to ask.1/2

A quick briefing schedule has been set in this Colorado federal court case.
Notably, the TRO was filed alongside a motion for class certification. This means that, if granted, a TRO would apply to *all* 2022 HS grads declared ineligible for 2026-27 based on four seasons of play.

On the heels of that Ohio decision... (though filed last night) we have another lawsuit filed by members of the high school class of 2022 who finished four seasons in four years of college this past spring.
This one is a federal antitrust lawsuit seeking class action status.
5th year approved.
Excited to announce I’ve officially been granted my fifth year of eligibility.
