Why does it feel like there's a rush to auction Kenya to a select few? Trends I'm noting: Oil man: One man wants to source crude oil, refine it, supply the finished product, and own a significant stake in the pipeline that transports it. Add the push for protection against cheaper fuel imports, and it starts looking like one man wants control of the entire chain, from crude to pump. Moving to roads. Mau Summit–Rironi, Rironi–Malaba, James Gichuru–Rironi, more floors on Thika Road, and of course, tolled floors! Every other road is becoming a tolling opportunity. Please note: privatised tolls for about 30 years. Minerals. Blocks are being allocated in a hurry, with Shanta Gold among the prominent players. Can't mining be done by a state entity with a Kenyan-subscribed IPO ama pia hiyo watatudangote! Agriculture nayo haijaachwa. Sugar factories were handed to private operators on 30-year leases, at peppercorn land rent. With this supposed privatization efficiency, sugar imports continue. Now, 21 NCPB warehouses are lined up for handover to selected private operators, supposedly to fight other cartels. We are fighting cartels by handing public infrastructure to a select few? I dont know know, but I know KCC regional restructuring is not all that there is to it. Oil, roads, minerals, sugar, grain, milk. Is it efficiency and productivity we are chasing, or control of resources and supply of essential goods and services?

The new PAYE regime is nigh. It is now clear that the Bill is in the kitchen to give effect to the President’s declaration. From today’s update by the CS, National Treasury, the new PAYE regime appears to be taking shape. Major Highlights 1. The first band of the PAYE graduated scale is set to rise from 24,000 to 32,333 The Band will be Zero rated for Paye It means more of the first 32,333 of your monthly income will remain in your payslip ofvourse after giving way to AHL , NSSF &SHA . 2. Scrapping of personal relief. Personal relief has been in existence in Kenya for decadesdating back to 1997. It has been evolving though . The scrapping of the Personal relief is in line with the Medium-Term Revenue Strategy 2024/25 - FY 2026/27), With the 1st band in the PAYE graduated scale being zero rated , the scrapping of personal relief present No exposure . This is a great move

Starting in January 2027, It is KRA that shall FIRST calculate for you, what income it believes you & your business earned in 2026, And what income tax you shall therefore pay. KRA will do this by generating a pre populated income tax return using the information it already has, such as: - eTIMS data - PAYE records - Withholding tax records - Plus any other information KRA can find KRA shall then send you this pre filled return by 31st January 2027. Once you receive it, you have 60 days (February and March), and 2 OPTIONS only. To either: 1. Confirm & accept KRA generated return, if the numbers are correct. Or, 2. Reject & amend KRA generatd return, if KRA got the numbers wrong. If you take this route, you shall provide your own numbers together with supporting documents to KRA. - If you make your amendments late. Or, - You do not make any amendments at all, KRA shall congratulate you conclude that you have agreed with its originally generated assessment, and you shall pay the KRA generated tax bill. After that, you shall use the amended or originally accepted return to file your taxes as follows: - If you are a human being, file by April 30th 2027. - If you have no flesh & blood (company, partnership, trust, etc), file by June 30th. (Or the last day of the sixth month after your accounting year ends.) One more critical mistake to watch. - When that time comes, do not assume KRA's numbers are always correct. The law has expressly given you the right to accept or reject the pre-populated return before filing. Lessons: • Proper bookkeeping is King in 2026. • Mark the new tax timelines in your calendar. This is a new thing in Kenya, so reread slowly.

KRA is now cruising with the big boys. Its budget has gotten a serious boost. The newly signed Kenya Revenue Authority (Amendment) Bill 2026 provides that KRA must receive not less than 2% of the taxes it collects. For context. In the 2025/2026 financial year, KRA collected about Sh2.5 trillion. Its budget allocation was Sh27.9 billion. That's roughly 1.1% of the Sh2.5 trillion. Now, under the new law, if KRA collects Shs2.5 trillion, its allocation of at worst 2% would be: -2.5 trillion × 2% = Sh50 billion. That's an additional 22.1 billion compared with the 27.9 billion allocation. Almost 80% more! KRA could invest this new money into. - Hiring more staff to handle customer service, or to do tax audits. - Better technology and AI to detect tax redflags. - More investment in servers and systems to make iTax never go down again. - Better taxpayer education. - Better staff remuneration and working conditions. And more. Of course, more funding alone does not guarantee better services. How KRA spends this money will matter. But this creates a serious incentive for KRA. Because, the more tax they collect, the more money they get back. Will taxpayers see better services, or more aggressive tax collection?

Hello KRA. KRA has appointed many taxpayers as Withholding VAT Agents. They are asking a practical question. Suppose I walk into a supermarket to buy taxable goods for my business. The supermarket gives me an eTIMS receipt and I pay at the till. How exactly am I supposed to withhold the 2% VAT? Do I tell the cashier, - I am a Withholding VAT Agent, so please deduct 2% from this bill. I will remit the 2% to KRA myself and send the supermarket a withholding VAT certificate. Will the supermarket trust such a promise from a random customer at the till? What is your suggestion for counter purchases? @KRACare @KRACorporate
Replying to @WashiraX
If you purchase something from the supermarket - how do you withhold the vat if you have been appointed an agent

Having an eTIMS Invoice Is No Immunity to a Tax Audit: eTIMS Never Replaced Substantive Tax Laws The introduction of eTIMS improved transparency and traceability of transactions within the tax system. However, it is important to understand that having an eTIMS invoice does not provide immunity from a tax audit, nor does it replace the application of substantive tax laws. Under Section 15(1) of the Income Tax Act (ITA), expenses are deductible only if they are wholly and exclusively incurred in the production of income. This is a substantive legal test that all eTIMS expenses must undergo. A legitimate eTIMS invoice does not change the legality of an expense as per ITA Section 15. If an expense is personal or incurred for non-business purposes, it remains disallowable regardless of the fact that it was validly generated through eTIMS. Section 17 of the VAT Act, 2013 clearly outlines that input VAT is claimable only to the extent that goods or services are used or intended to be used in making taxable supplies. This means certain inputs remain restricted. For example, VAT relating to personal expenses is generally not claimable, even where a valid invoice exists. Even with eTIMS, TPA still gives the tax authority the power to review and audit your books. Section 59 of the TPA gives the tax authority power to review and verify the tax affairs of a taxpayer, requiring the production of records, documents, and supporting information even after returns have been filed using the auto-populated invoices transmitted through eTIMS. If the review and audit result in disallowing some expenses that did not meet the test of Section 15(1) of the ITA or Section 17 of the VAT Act, the tax authority can issue an additional assessment (Section 31). It is therefore critical to understand that the fundamentals did not change. What eTIMS did was to properly operationalize enforcement of the tax laws by ensuring transaction visibility. If a dispute arises, Section 56 , TPA places the burden of proof on the taxpayer to demonstrate that the Taxman’s tax decision is incorrect. True tax compliance depends on the proper application of substantive tax law.

As an update to this post, I once again last Sunday tested KRA officers at JKIA on the interpretation of Section 114 and the Fifth Schedule, Part B, Item 5 of the East African Community Customs Management Act (EACCMA) and their own guidance posted on their website.
Replying to @KRACare
@KRACare Your officers at JKIA charged me duty on a pair of bike lights worth less than $200. KRA’s own passenger clearance guidance allows a USD 2,000 concession applicable to goods for personal and/or household use. They claimed they were "spare parts" and therefore non-exempt
