So basically, today PHP got two critical bugs that let anyone run code on your server without even logging in, which is bad, and then the details leaked before the patch was even out, which is worse, and it works on WordPress and MediaWiki and Magento and Joomla and Laravel, and Censys says like 1.5 million servers are running a version with no fix, so the NSA was like "take your system offline," and the FBI was like "take your system offline," and CISA and the UK and CERT-EU were all like "take your system offline," and then the Prime Minister of Japan, the actual Prime Minister, posted at 5:55 in the morning telling 48.8 million people to take their system offline, so everyone took their system offline, like the Dutch cybersecurity agency took its own website offline, and the Dutch parliament went offline, and the Port of Rotterdam went offline, and Finland and France and Denmark started pulling government sites, and Wikipedia went down, and Archive.org went down, and Asana and GOG and Something Awful went down, and the University of Vienna's webmail went down for some reason, and that's just PHP. I completely missed THIS in regard to the $PENGU ETF...
Not sure how I didn't know this, but the SEC changed the process to get ETF's approved.
This likely explains why the $PENGU ETF was withdrawn by the CBOE earlier this year.
What does this mean for the ETF now?
Due to the rule change, for a generic listing, the 19b-4 is no longer what the $PENGU ETF needs.
Instead what $PENGU needs is to fulfill 3 requirements:
1. It trades on an ISG-member market.
2. It underlies a DCM futures contract with six months of history.
3. A listed ETF already provides at least 40% exposure to it.
Now let's review each of the three:
1. ✅
This is likely already complete, with Bitnomial listing $PENGU spot on July 1, 2026.
2. ✅ but ⏰
Bitnomial listed $PENGU futures on July 17, 2026. This fulfills the first requirement, but 6 months puts us at January 17, 2027. There's a bit of confusion on the timelines as Bitnomial became CFTC certified on August 27, 2026. Perhaps this means the earliest date is February 27, 2027.
3. ❌
No listed ETF currently provides 40% exposure to $PENGU.
The interesting thing is, for #3, they do not have to wait until January to make this happen. A pure spot ETF that holds 100% of $PENGU would for sure have to wait until at LEAST January 17th, but an ETF that holds 40% or more can pop up any day.
The takeaway from this update:
The Pudgy team is probably working very hard to meet that third requirement to get $PENGU in an ETF at a 40% or more allocation. Once this is complete, then a spot ETF itself would become possible after January 17th.
With that being said, in this scenario, it would only be $PENGU getting an ETF, not the NFT's.
In regard to the NFT's, there are still a lot of regulations that would have to change to make it possible.
I think it is safe to say we might not see an NFT ETF for a while, and if Pudgy Penguins are the first to have one, it would be mega bullish, but right now it is completely unknown if it is possible.
