Shellem told reporters after the meeting that "in light of the attorney general's letter (...) we responded to that by not authorizing."
Shellem noted that they did authorize their attorneys to file an appeal in the civil case brought by Ben Gamla against the board.
"It gives us the option to appeal the judge's decision on the preliminary injunction."
When the board returned from executive session, Chairman Brian Shellem said they are skipping the revised application "in light of" the @Okla_OAG opinion that was published yesterday.
"We are bound not to take the vote based on the attorney general's opinion," Shellem said.
Yesterday, @Okla_OAG issued an opinion stating the SCSB does not have the statutory authority to hold a vote on another revised Ben Gamla application.
SCSB has a special meeting at noon with such a vote on the agenda.

Small update: @Okla_OAG has dismissed his lawsuit against the board in Oklahoma County without prejudice, leaving the door open for future legal action.
A statement from Drummond's office announcing last week's dismissal read, "Any new application from Ben Gamla would have to start over and could only apply to a later school year."

At today’s SCSB meeting, Ben Gamla’s application for initial authorization fell short of approval in a 4-3 vote. Five affirmative votes are required for approval.

Farley said a lack of clarity may have contributed to the decline.
"The prospect of a court yanking the rug out from under the school was something that a lot of parents just had a lot of concern about. So (a) higher court ruling would certainly be helpful."
Ferate said he would not be surprised if Ben Gamla files a motion for contempt as a result of today's action.
"We will have to see what they do. But being a lawyer, I presume that is probably what is going to come."
.@brettfarley, an attorney and member of Ben Gamla's board, said the lack of approval is a "setback."
"We are obviously disappointed. We were very excited about the prospect of starting the school, so this is a setback, but it is not the end."
Just weeks after the order was published, a letter revealed dwindling enrollment projections. Although the school projected more than 300 students at one point, it recently projected 10.

A Sept. order from the Western District of Oklahoma granting a preliminary injunction opened the door for SCSB to approve the school's application. You can read the full order below:
