BIG CLARIFICATION BY THE ELECTION COMMISSION ON FORM 6 AND SIR The ECI has clarified that voters whose names do not figure in the draft electoral rolls can submit Form 6 for fresh inclusion — even if they were enrolled previously. Crucially, the Commission says: • Previous enrolment does not make the Form 6 declaration false. • No action under Section 31 of the Representation of the People Act, 1950, can be initiated merely because the elector was previously enrolled and has submitted Form 6. • This protection applies provided the elector is not already enrolled in another Parliamentary or Assembly constituency and the declaration is otherwise lawful. The clarification comes amid concerns among deleted voters that submitting Form 6 could expose them to prosecution for making a false declaration. The ECI has directed Chief Electoral Officers to publicise this clarification widely.
