We need a study to see the nexus if any between the weddings of a community and their proximity to State House. Our Kikuyu brothers and sisters during the Kibaki and Uhuru presidency taught us the A, B, C of grand weddings and all it's glitter and pizzas. Every weekend Kenyans were treated to an expensive wedding out of this world. Now our Kales brothers and sisters have taken grand weddings to another level. Since Ruto took power in 2022 Kikuyu weddings don't cross River Chania. They have become dull village affairs. So does it mean members of Kikuyu and Kalenjin do grand weddings only when a brethren is in power? I know other Kenyans are OK with modest weddings in their local churches and primary schools where guests are served fanta and queen cakes...so good people what is the nexus between grand weddings of members of Tribe X and the tenant in State House?
“He who finds a wife finds a good thing and receives favor from the Lord." — Proverbs 18:22.
Congratulations, Faith Cheluget and Allan Wanderi, on your beautiful union in marriage.
We wish you abundant blessings and a lifetime of love, happiness, and prosperity as you embark on this new chapter of life together.

THE ULTIMATE "SET IT AND FORGET IT" CSR:
WHY STANCHART’S "SEEING IS BELIEVING" IS A PR BLACK HOLE.
☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●
Word on the corporate street is that Standard Chartered picked the laziest CSR vanity project in the game. One with ACCOUNTABILITY PARAMETERS SO DELIGHTFULLY VAGUE they belong in the fiction section.
The cynics are pointing out a brutal PR loophole:
●○●○●○●○●○●○●○
A blind person you "help" this year will almost certainly still be blind next year. And the year after. It’s the ultimate unaccountable metric.
●○●○●○●○●○●○●○
Because society already expects a blind person to remain blind, nobody bats an eyelid when your "beneficiary" shows up next year with the exact same struggle.
FAILURE AND SUCCESS LOOK IDENTICAL. It’s a corporate dream. You can literally do nothing and no one will ever be able to prove the aid didn't work.
Let’s look at the cold, hard WHO numbers to see if this massive global CSR Echo Chamber has actually moved the needle:
[-1-] >>: THE PRODUCTIVITY LOSS: Global losses from vision impairment climbed from US$ 268B (2007) to US$ 410B (2018) and are sitting at a staggering US$ 411B (2026).
[-2-] >>: THE "BENEFICIARY" PIPELINE: The global blind population grew from 32M (2010) to 36M (2015), and is sitting at 44M (2020–2026).
Meanwhile, look at the sheer scale of the "CSR worthy competition" over that same 2020–2026 period:
●○●○●○●○●○●○●○
Autism spectrum disorders are at 61M people, Diabetes is at a staggering 830M, and reversible mental disorders are at 1B.
●○●○●○●○●○●○●○
The data is damning: The situation is deteriorating, and decades of global CSR have fallen flat on their face. Blind people are actually fewer in number compared to these other massive health crises. The psychiatrists and mental health patients? They are drowning.
Perhaps it’s time @StanChart picks a CSR lane where they can make an identifiable difference, instead of throwing money at a problem they can't even measure.
Honestly, "Seeing is Believing" might as well be rebranded to "They Will Never Believe", because they will never see, and based on these numbers, the program is just enthusiastically recruiting new people into the dark.
But hey, let's give @StanChartKE their flowers:
●○●○●○●○●○●○●○
Long before modern marathons became the equivalent of well-organized, sweat-soaked physical Tinder dating sites, infiltrated by dating crooks and fitness influencers, Stanchart was doing genuine marathon runs. They were pioneering the game before it was soiled.
●○●○●○●○●○●○●○
SO YES, THEY MIGHT BE BLIND TO THEIR OWN CSR METRICS, BUT AT LEAST THEY KNEW HOW TO RUN A RACE.

Subirbhai,
The unfortunate thing about your statement is that it presupposes that you are indispensable. That, in itself, is a deeply troubling position to take when humanity is concerned.
The mathematics is as simple as DOUBLE-ENTRY ACCOUNTING:
☆●☆●☆●☆●☆●☆●
Anyone CREDITING your head is treating you as UNNECESSARY. Anyone DEBITING your head is treating you as NECESSARY.
☆●☆●☆●☆●☆●☆●
But here is the irony:
Every day you remain alive, someone, somewhere, is carrying a debit on your behalf. You are benefiting from someone's labour, knowledge, sacrifice or contribution, whether you acknowledge it or not.
If those people collectively decided to write you off as unnecessary, you might soon discover just how dependent your world is on the very people you consider dispensable.
☆●☆●☆●☆●☆●☆●
Nobody is indispensable. But nobody is so insignificant that the world can function without their contributions.
☆●☆●☆●☆●☆●☆●
Perhaps that realisation would inspire a little more humility and a little less certainty about your own importance.

🔥THE BRUTAL TRUTH:
ONLY FAILING BUSINESSES GET SOLD TO THE PUBLIC — PROFITABLE ONES NEVER LEAVE FAMILY HANDS 🔥
☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●
IF A BUSINESS IS TRULY GOOD, THE FOUNDERS WILL NEVER GIVE IT AWAY.
Look at the evidence:
1>>: MSC Shipping — family-owned.
2>>: Cargill — family-owned.
3>>: Koch Industries — family-owned.
4>>: Mars — family-owned.
5>>: Louis Dreyfus — family-owned.
These are MASSIVELY PROFITABLE companies. NOT ONE OF THEM IS ON THE STOCK MARKET BEGGING FOR YOUR MONEY.
Why? BECAUSE THEY MAKE MONEY. THEY DON'T NEED YOU.
THE ONLY REASON A FOUNDER SELLS SHARES TO THE PUBLIC IS BECAUSE THE BUSINESS IS A LOSS-MAKING BURDEN HE WANTS TO DUMP ON FOOLS.
THEY DON'T WANT IT. WHY SHOULD YOU?
Let me paint you a picture:
●○●○●○●○●○●○●○
A man drinks away his entire NGO salary in pubs for years. Donald Trump cuts the funding. Suddenly he's "offloaded." He now believes, because he's been drinking like a goat, that running a pub is profitable.
He SELLS ANCESTRAL LAND he never bought (because he was too busy drinking), uses the money to open a pub, and surprise, surprise, starts making losses like every pub on earth does unless it's a MONEY-LAUNDERING FRONT.
Now broke, he approaches his equally stupid friends and says:
"I've already invested in the infrastructure. I'm only looking for investors to buy shares because my own stake is………... gone. To what? Don't ask."
1>>: A REAL AND SOLIDLY STOIC FRIEND tells him: “Go Die with Your Alcohol Business”.
2>>: A EQ COWARD says: "Mimi biashara ilinikataa."
3>>: A FELLOW COCONUT invests, and just expands the number of losers.
●○●○●○●○●○●○●○
THAT IS THE STORY OF A KENYAN SUPERMARKET OFFLOADING A DEAD INVESTMENT TO KENYANS THROUGH AN IPO AT 7 BOB.
And to spice it up? They claimed the WORLD BANK was interested in those shares. KWANI WORLD BANK SIKU HIZI INAENDESHWA NA SUBSTANDARDS?
WHAT DOES A SUPERMARKET ACTUALLY OWN? NOTHING. ABSOLUTELY NOTHING.
1>>: Stocks/Inventory? Owned by SUPPLIERS who are paid after 60 days after goods are sold, and even unsold goods GRN’d back to suppliers.
2>>: The Warehouses they call "supermarkets"? Owned by LANDLORDS and rented at thin anchor-tenant rates, with the real rental burden on auxiliary shops against dead footfall narrative.
3>>: The Shelves? Owned by LESSORS at 100% asset leasing arrangements.
4>>: The Staff? 90% are MERCHANDISERS employed by SUPPLIERS.
5>>: Promotions & Marketing? Ruthlessly DEDUCTED FROM SUPPLIER INVOICES.
6>>: Rebates? OUTRIGHT THEFT FROM SUPPLIERS defying the doctrine of fair treatment and fair practice.
●○●○●○●○●○●○●○
THE SUPPLIERS ACTUALLY OWN THE SUPERMARKET. NOT THOSE CONMEN.
●○●○●○●○●○●○●○
AND HERE'S THE FINAL INSULT:
●○●○●○●○●○●○●○
Once they've sold their stake, ALL THE MONEY IS MOVED TO THE United Kingdom for "other important investments."
Because, even to them, a SUPERMARKET is a BAD INVESTMENT.
●○●○●○●○●○●○●○
CONCLUSION:
●○●○●○●○●○●○●○
YOU MUST BE THE ORIGINAL FOOL TO BUY SUPERMARKET SHARES. The founders know it's dead. THE SUPPLIERS OWN EVERYTHING. The World Bank claim must be a lie. The money leaves the country the moment they cash out.
WHAT ARE YOU BUYING? A logo. A name. A rented warehouse full of other people's goods?
THEY ARE COUNTING ON YOUR STUPIDITY. PROVE THEM WRONG or RIGHT.

Fact No. 109
●☆○☆●☆○☆●☆○☆●☆○☆●
FACT: Most men aren’t doing DNA tests because they’re thirsty for truth. They’re doing them because they’re praying for a negative result, a golden ticket to do what men do best: RUN AWAY.
●☆○☆●☆○☆●☆○☆●☆○☆●
Kenya has very few accredited paternity DNA testing centres. In those accredited centres, you can’t sneak in with a child or a contaminated sample alone. The mother and the father must both be present during sample collection for results to be realistically admissible .
The UNACCREDITED ones? They give over 60% wrong results and wrong advice. It’s like going to a village quack who gives you painkillers until you die of the underlying infection.
There is no one who understands the conception process better than a woman, because she is the recipient. It's like arguing with a child about bottled milk. The child knows type of milk came, when it came, and from which bottle it came from.
●☆○☆●☆○☆●☆○☆●☆○☆●
Pipes feeding houses with water don’t know which house failed to receive water. But the individual house with piped infrastructure knows when the water came, when it didn’t, and from which pipe it came from.
●☆○☆●☆○☆●☆○☆●☆○☆●
Unless a woman is malicious, which is very rare, she knows the father with 99.9% certainty. And most of the time, she’s telling the truth.
A male animal’s natural instinct is to flee from his children. If it weren’t for the rule of law governing humans, men, just like their male animal counterparts in the jungle, would take off and go make other children elsewhere. Men are allergic to children, they’d rather sprint than stand still. The only thing stopping them from turning fatherhood into a safari is the law.
But because we have the law, if you want a DNA paternity test that is admissible, the mother needs to consent, either voluntarily or through a court order, and you’ll use an accredited centre. No shortcuts. No sneaking. No running.

<1>:
WITHOUT BRIBERY and corruption, most people would have LITTLE MOTIVATION to join the POLICE service. Indeed, some police officers might find themselves sympathising with or even JOINING DEMONSTRATORS on the streets. The question, therefore, is:
▪︎●▪︎●▪︎●▪︎
"Who wouldn't want police to join demonstrators? That person is the strongest advocate for police corruption"
▪︎●▪︎●▪︎●▪︎
<2>:
WITHOUT SCHOOL UNREST, there would be no incentives to teach. Who wants to die before CBAs are honored 1,000 years later?
It is a whispered fact that SCHOOL UNREST, including serious incidents of ARSON is organised or facilitated by teachers through there principals.
▪︎●▪︎●▪︎●▪︎
If parents were required to send students back with KES 20,000 each, a school with 500 students would represent KES 10 million. The arithmetic is straightforward and mouth watering, at least at a school level.
▪︎●▪︎●▪︎●▪︎
<3>:
WITHOUT CORRUPTION, ELECTIVE POLITICS would not be attractive.
▪︎●▪︎●▪︎●▪︎
Why would someone willingly manage a constituency of perpetual “toa chai” demands on an official gross monthly salary of approximately KES 700,000, if public office offered no opportunity for behind the tent enrichment?
▪︎●▪︎●▪︎●▪︎
<4>:
WITHOUT CORRUPTION, MOST of our judges would NOT be MOTIVATED to seek judicial office.
▪︎●▪︎●▪︎●▪︎
Who would be encouraged to preside over criminals such as Kenyans 24 hours without sleep and without a side amusement?

●☆○☆●☆○☆●☆○☆●☆○☆●
LESS than 1% of people globally who trade in SHARES successfully make a consistent full-time living from it, and an even smaller fraction actually get rich.
Of that tiny fraction who do get rich, VIRTUALLY ALL of THEM had INSIDER INFORMATION.
Trading on insider information is illegal, yet it is precisely what those who "MAKE IT" do. They possess information that you do not have.
If share trading were a GENUINE PATH to ECONOMIC PROSPERITY, then the long-suffering shareholders who attend AGMs of blue-chip companies would have seen their fortunes transformed. Instead, they remain IMPOVERISHED, receiving a mere KES 120 in annual dividends sent to their M-PESA.
●☆○☆●☆○☆●☆○☆●☆○☆●
HINT: Look for INSIDER INFORMATION, then trade. Otherwise, you will simply be one of the shares being traded, a COMMODITY, NOT an INVESTOR.

To be well liked and loved politician in Central Kenya is very easy...talk nonsense, think like a toddler and abuse H.E Ruto...Mt Kenya people will worship you like a god.
African RABBI retweeted
I think H.E WILLIAM RUTO misses the point completely. Kenyans go to politics because politics is the quickest and easiest way to become a billionaire at Wajiku's expense...stealing from the public comes so natural to the political elite. Business and manufacturing are difficult..look at the billionaire governors, heads of state corporations, Uhuru's four dollar billionaires...everywhere!

Come August 2027, InshaAllah H. E William Ruto will be re-elected for a second matter. But he will make it the difficult way...the usual 50 plus 1 struggle of pain and suffering. If he listened to me and undertook a root and branch reform of the country, went after Uhuru's 4 dollar billionaires, jailed Governors who stole billions of public funds, went after and jailed JurisPESA judges right from the Supreme Court down to magistrates (and i had a list), went after heads of state corporations whose wealth is just too indecent for a poor third world country, reestablished aw and order(this is gooism has become normal), President Ruto will be winning August 2027 between 60 to 63% with only Wamunyoro wailing like a mad man on the foot of Mt Kenya drinking hot uji...but let us not cry over spilt milk. In my humble view despite Ruto's abject failure to reform the country on the law and order side, he did amazing well on the economy, on infrastructure, on sharing the cake, on creating a conducive environment for investors, on creating inclusivity, on agriculture (he did nothing for my camels at Bangal). So, we must support Ruto's reelection BUT on condition that he will address the "law and order" deficit in his balance sheet...and that a radical bloody surgery of JurisPESA judges will commence on 1st May 2028 (InshaAllah)...Ameen ya Allah.

President William Ruto has now clarified, to the amusement of Kenyans, the same citizens who have perpetually been told they are only KES 2,000 away from becoming entrepreneurs selling boiled eggs and coffee Ndubia, that when he announced that Kenya was open for investors, apparently the invitation did not extend to every roadside hawker crossing in from a neighboring country.
The announcement has predictably been dragged into the political slaughterhouse. But beneath the politics is a far more disturbing revelation:
●○●○●○●○●○●○●○
The apparent scale of undocumented Burundian migrants in Nairobi.
●○●○●○●○●○●○●○
The fact that a million people could be seeking documentation at the Burundian Embassy raise an obvious question:
●○●○●○●○●○●○●○
Was the Government itself unaware of the magnitude of the immigration problem?
●○●○●○●○●○●○●○
Because let's separate the issues: Visa-free EAC movement does not mean documentation-free entry.
When Kenya opened its borders to fellow East Africans, nobody announced:
●○●○●○●○●○●○●○
“Come without birth certificates, IDs, passports or the required immigration documentation.”
●○●○●○●○●○●○●○
Those are basic documents. Even Kenyans have to navigate the paperwork.
So the real question is not simply how many came? It is:
●○●○●○●○●○●○●○
HOW DID THEY GET THROUGH THE BORDER, SETTLE IN KENYA AND REMAIN HERE WITHOUT THE BASIC IMMIGRATION CONTROLS FLAGGING THEM?
●○●○●○●○●○●○●○
That is where the Government's immigration machinery deserves a very serious interrogation.
On this particular point, I find myself agreeing with the man whose deep and disturbing Murang’s accent can make even his own name sound like a constitutional amendment, DIDI NYORO. If the scale of undocumented immigration is anywhere near what is being broadcasted, then the problem is not merely the people who entered.
But perhaps the Burundians don't yet understand the darker subplot.
●○●○●○●○●○●○●○
This isn't merely an immigration conversation. It is a Voters Conversation. It's a TAX-BASE CONVERSATION.
●○●○●○●○●○●○●○
Kenyans have already been squeezed from every available fiscal direction. Income tax. Consumption taxes. Fuel levies. Transaction charges. Business taxes. Housing levies. The taxpayer has been put through a FISCAL WASHING MACHINE.
So after accelerating the taxation of Kenyans until the last shilling is making distress calls, where does the taxman look next?
New taxpayers. And suddenly, that man selling boiled eggs and coffee Ndubia becomes economically interesting. So, to our new economic participants:
●○●○●○●○●○●○●○
Get your documentation right.
●○●○●○●○●○●○●○
Because once the paperwork is clean, the Government can finally establish exactly who you are, where you came from, what you're doing here and most importantly in the current fiscal climate:
●○●○●○●○●○●○●○
How much tax you can pay.
●○●○●○●○●○●○●○
Welcome to Kenya. THE BORDER MAY BE OPEN. THE TAXMAN'S CALCULATOR IS EVEN MORE OPEN.

☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●
H.E. @Rigathi Gachagua went to Embu today, desperately clinging to relevance like a man drowning in a political tsunami, whining that Prof. @KindikiKithure is "dividing" Mt. Kenya.
But here's the brutal punchline that Gachagua's crumbling ghost can't seem to process: “THE ONLY THING DIVIDING MT. KENYA IS GACHAGUA'S DELUSIONAL OBSESSION WITH A THRONE HE WILL NEVER SIT ON.
Because let's be ruthlessly clear about the elephant in the room that every sane Kenyan already knows:
●○●○●○●○●○●○●○
>● GACHAGUA IS IMPEACHED.
>● GACHAGUA CAN NEVER HOLD PUBLIC OFFICE AGAIN.
>● GACHAGUA IS A POLITICAL CARCASS WALKING AROUND PRETENDING HE'S STILL ALIVE.
●○●○●○●○●○●○●○
The Njuri Njeke and Kiama Kia Muembi, two heavyweight councils of elders have thrown their weight behind Prof. Kindiki. And what does the impeached political cadaver do?
●○●○●○●○●○●○●○
He runs to Embu whining about division? Tragicomedy at its finest.
●○●○●○●○●○●○●○
Because you cannot "divide" something that was NEVER YOURS to begin with.
Gachagua's "Mt. Kenya crown" was always a figment of his dangerously scripted imagination, a political pipedream that has now collapsed into the dustbin of history where it belongs.
For 60 years, the western bloc, “Kiambu, Murang'a, Nyeri” behaved like they owned the mountain. Now the East has arrived. And they didn't come begging.
They came with Kindiki, a man who can ACTUALLY hold office, unlike Gachagua whose political career was permanently terminated by the Constitution. The Message from aMeru and aEmbu Is Devastatingly Simple:
●○●○●○●○●○●○●○
"ENOUGH WAITING. WE ARE BUILDING OUR OWN CENTRE OF POWER."
●○●○●○●○●○●○●○
And Gachagua?
>● He can shout from every Landcruiser rooftop.
>● He can summon politicians who are just humoring a dead man walking.
>● He can organize rallies that mean absolutely nothing because he's DISQUALIFIED.
Here's the uncomfortable truth that Gachagua's handlers are desperately trying to suppress:
●○●○●○●○●○●○●○
You cannot credibly claim to speak for an entire region when YOU CAN NO LONGER EVEN SPEAK FOR YOURSELF IN PARLIAMENT. He is impeached, period. And the appellate courts will uphold his impeachment on the simple ground that the constitution never intended judges to create a constitutional crisis by allowing both a COCONUT‑HEAD and a SOPRANO to be legitimate Deputy Presidents at the same time.
●○●○●○●○●○●○●○
The impeachment wasn't a suggestion. It was a political execution. And yet here he is pretending he's still the kingpin of a mountain that has clearly moved on without him.
What Happens When the People You Expected to Follow You Like Cattle Realize their Herdsman Has Been PERMANENTLY CAGED?
That is the political insult hiding underneath the KINDIKI PHENOMENON.
Kindiki isn't just another politician. He's the political vehicle through which Mt. Kenya East is telling the Western establishment:
●○●○●○●○●○●○●○
"We are no longer asking for permission especially from a man who CANNOT even hold a county executive position, let alone the presidency."
●○●○●○●○●○●○●○
And Gachagua's reaction? Desperate comedy.
Gachagua can:
>● Tour the mountain without any official capacity.
>● Complain about Mt. Kenya division from the sidelines of irrelevance.
>● Pretend he still matters to a dwindling audience of sympathizers.
>● Issue declarations that carry zero constitutional weight.
But here is what he CANNOT do:
>● HE CANNOT HOLD PUBLIC OFFICE.
>● HE CANNOT BE PRESIDENT.
>● HE CANNOT EVEN BE A COUNTY EXECUTIVE.
>● HIS KINGSHIP PIPEDREAM IS CONSTITUTIONALLY DEAD.
Gachagua may have perfected the political theatre of presenting himself as the undisputed voice of the mountain. But that theatre has now become tragic farce.
Because the East has entered the arena, and unlike Gachagua, KINDIKI IS ELIGIBLE TO HOLD OFFICE.
●○●○●○●○●○●○●○
Mt. Kenya does not belong exclusively to "Kiambu, Murang'a and Nyeri", and it certainly does not belong to an impeached politician who can only rule after his resurrection from the dead.
●○●○●○●○●○●○●○
For 60 years, the western bloc enjoyed disproportionate influence. Now the East has arrived with a KINGPINSHIP candidate: PROF. KITHURE KINDIKI.
A man who:
>● Can actually hold office.
>● Has constitutional legitimacy.
>● Is endorsed by powerful councils of elders.
>● Represents a genuine power shift.
Gachagua's greatest threat isn't KINDIKI himself.
●○●○●○●○●○●○●○
It's the realization that aMeru and aEmbu have discovered they don't need permission from an IMPEACHED, CONSTITUTIONALLY DISQUALIFIED DREAMER to make their own king.
●○●○●○●○●○●○●○
Kindiki's emergence fundamentally changes the arithmetic. But which arithmetic? Gachagua's political palace?
It was never a palace.
It was a house of cards built on a dangerously scripted pipedream, and the wind of impeachment blew it down permanently. The Coronation May Not Yet Be Complete. BUT GACHAGUA'S RACE IS FINISHED.
The East has entered the political arena. And this time, it isn't coming to cheer from the stands like domesticated Mt. Kenya Pets. IT IS COMING FOR THE CROWN.
And Gachagua? He can only watch from the political graveyard: Impeached, disqualified, and permanently irrelevant.
The kingdom has started producing its own kings. And the OLD KING?
●○●○●○●○●○●○●○
He's just a ghost whispering fantasies to anyone still FOOLISH ENOUGH TO LISTEN.
●○●○●○●○●○●○●○
Gachagua's Kingship Desire is Not Political Ambition. It is a dangerously scripted pipedream, one that the constitution has already killed.
WAKE UP, MT. KENYA.
●○●○●○●○●○●○●○

BEYOND REASONABLE DOUBT?
WHY THE OBADO MURDER JUDGMENT COULD COLLAPSE ON APPEAL:
A FORENSIC ANALYSIS OF CRIMINAL CASE NO. 46 OF 2018
☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●☆●
PROLOGUE: A NATION WATCHES, A QUESTION LINGERS
☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•
On 23rd July 2026, Lady Justice Cecilia Githua of the High Court of Kenya delivered a judgment that sent shockwaves across the nation. Former Migori Governor Zacharia Okoth Obado (@GovernorObado), together with his personal assistant Michael Juma Oyamo and clerical officer Caspal Ojwang Obiero, were convicted of the murder of Sharon Belyne Otieno, a 26-year-old university student who was 28 weeks pregnant.
The prosecution had called 42 witnesses and produced 81 exhibits. The court found that the THREE accused acted with common intention, with Obado providing "motive, instigation and funds" in a scheme that led to Sharon's death.
But this article is not about celebrating a conviction or mourning an acquittal. It is about something far more fundamental:
●○●○●○●○●○●○●○
The integrity of the criminal justice system itself. We are not defending Obado. We are defending the law. We are demanding that our judges, our prosecutors, and our investigators meet the standards that the Constitution and the Penal Code demand. Because when shortcuts are taken in the name of "JUSTICE," it is NOT JUSTICE THAT SUFFERS, IT IS THE VERY FOUNDATION OF OUR REPUBLIC.
●○●○●○●○●○●○●○
As the Court of Appeal has repeatedly reminded us, and as the Supreme Court affirmed in “Republic v Ahmad Abdolfadhi Mohammed [2019] KESC 48 (KLR)”.
●○●○●○●○●○●○●○
CIRCUMSTANTIAL EVIDENCE must form "a chain so complete that there is no escape from the conclusion that the accused person, and nobody else, committed the offence charged."
●○●○●○●○●○●○●○
The question that haunts this judgment is whether that chain was truly complete, or whether it was forged with haste, anchored on inference rather than evidence.
[-1-] >>: THE JUDGMENT IN SUMMARY, AND WHY WE MUST SPEAK
☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•
(-A-) WHAT THE TRIAL COURT FOUND.
The prosecution's case, as distilled by the trial court, rested on the following pillars:
[<a.1>] The RELATIONSHIP: Obado was in an intimate sexual relationship with Sharon, who became pregnant.
[<a.2>] The PRESSURE: Obado allegedly pressured Sharon to abort the pregnancy, even giving her KES 30,000 for that purpose.
[<a.3>] The JOURNALIST: A protected witness (PW9, alias XYZ), a journalist, was brought in by Sharon to publish her story and force Obado to take responsibility.
[<a.4>] The MEETINGS: A series of meetings were held, at Rapogi, at various Nairobi hotels, and finally at Graca Hotel in Rongo on 3rd September 2018.
[<a.5>] The ABDUCTION: PW9, the journalist and Sharon were abducted in a Toyota Fielder (KCL 481K) owned by the 3rd accused's wife. The journalist ESCAPED; Sharon was fatally executed (RIP).
[<a.6>] The BODY: Sharon's lifeless body was discovered near Owade River on 4th September 2018, with multiple stab wounds.
[<a.7>] The COVER-UP: The 2nd accused made a false abduction report and obtained forged medical records through the 3rd accused.
[<a.8 >] The DNA: DNA evidence confirmed Obado was the biological father of Sharon’s Unborn Baby.
The trial judge concluded that the prosecution had proved its case beyond reasonable doubt.
(-B-) WHY THIS ARTICLE MATTERS.
In Kenya, judges do not merely apply the law, they make laws. Every judgment sets a precedent. Every conviction or acquittal sends a message about what our society tolerates and what it punishes.
When a High Court judge convicts three men of murder on CIRCUMSTANTIAL EVIDENCE, that judgment becomes binding authority in every subordinate court in the country. It tells magistrates:
●○●○●○●○●○●○●○
"This is how much evidence you need. This is the standard. This is what “BEYOND REASONABLE DOUBT' MEANS."
●○●○●○●○●○●○●○
If that judgment is flawed, if it rests on inferences rather than proof, on suspicion rather than certainty, then every subsequent case built on its authority is also flawed. The RIPPLE EFFECTS ARE INCALCULABLE.
This is why we must speak. Not to defend Obado, but to defend the rule of law.
[-2-] >>: THE FIVE MANDATORY ELEMENTS, A FORENSIC DECONSTRUCTION:
☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•
The legal foundation for the offence of murder is found in Section 203 of the Penal Code (Chapter 63 of the Laws of Kenya), which states:
●○●○●○●○●○●○●○
"Any person who of malice aforethought causes the death of another person by an unlawful act or omission is guilty of murder."
●○●○●○●○●○●○●○
This definition establishes five essential elements that the prosecution must prove CONJUNCTIVELY “beyond reasonable doubt” before a conviction for murder can be sustained. Let us examine each element against the evidence presented.
(-A-) ELEMENT ONE: FACT OF DEATH:
[<a.1>] The LEGAL REQUIREMENT:
The prosecution must prove that the deceased is actually dead. Without a body, or without irrefutable proof of death, a murder charge cannot succeed.
[<a.2>] What THE PROSECUTION PROVED:
The body was discovered by Moses Onditi Oguta (PW7) near Owade River. It was identified by the deceased's uncle, Victor Ochola Onyango (PW29), and a post-mortem was conducted by Government Pathologist Dr. Johansen Oduor (PW1).
[<a.3>] The GAP:
“If the deceased's body was severely mutilated, including the widely reported allegations that attempts were made to dissolve it using corrosive acid, it could be argued that comparative DNA analysis would have been the most reliable method of establishing the body's identity. While DNA testing was reportedly used to establish the paternity of Sharon's Unborn Baby, it remains unclear whether comparative DNA testing was also used to conclusively identify the deceased's body”.
[<a.4>] Why THIS MATTERS:
The first element of the offence must be established beyond any doubt. If there exists any reasonable possibility, however remote, that the body recovered was not that of Sharon Otieno, the entire prosecution case collapses at the first hurdle. The entire trial would have been embalmed on the fatal assumption that the recovered remains belonged to the deceased, thereby defeating proof of the corpus delicti and casting doubt on every subsequent evidentiary step built upon that premise.
Furthermore, if the perpetrators, who may still be at large, were capable of abducting Sharon at knifepoint and ultimately taking her life so mercilessly, it is equally conceivable that they could possess the means and opportunity to exhume and dispose of her body, thereby destroying crucial evidence and frustrating any future attempts to obtain forensic samples. This possibility underscores the critical importance of investigators conducting a thorough, meticulous, and scientifically sound investigation from the outset, beginning at the crime scene, to preserving the integrity of the evidence and safeguarding the administration of justice.
(-B-) ELEMENT TWO: CAUSE OF DEATH:
[<b.1>] The LEGAL REQUIREMENT:
For a murder charge to succeed, the prosecution must prove that the death resulted from a specific injury inflicted by the accused. The fatal injury must be clearly identified, and a direct causal nexus must be proved between that injury and the death.
Where the evidence establishes that death was instead caused by an independent INTERVENING EVENT, such as a myocardial infarction (heart attack), before the charged injuries had the opportunity to become the operative cause of death, the essential element of causation is broken. While the stress or trauma of the stabbing may have triggered the cardiac event, the evidence may show that an underlying pre-existing medical condition caused the heart attack to become the immediate and operative cause of death, rather than the stab wounds themselves.
In such circumstances, it may be argued that the injuries amounted to an UNLAWFUL ASSAULT but were not the legal or medical cause of death. Unless it is proved that the injuries directly caused or substantially contributed to the death, the essential element of causation is absent. Without proof of causation, a charge of murder cannot be sustained, although criminal liability for assault or another appropriate offence may still arise.
[<b.2>] What THE PROSECUTION PROVED:
Dr. Oduor testified that Sharon died from "severe haemorrhage due to penetrating force trauma with features of manual strangulation." He noted multiple external injuries: “two slash wounds under the ears, seven deep stab wounds, including one that penetrated her abdomen and the foetus”.
[<b.3>] The GAP:
The prosecution never identified or recovered the alleged MURDER WEAPON. From a forensic and evidentiary standpoint, the murder weapon is often the single most probative physical exhibit linking a suspect to the fatal act. While a post-mortem examination may establish the medical cause of death, for example, fatal stab wounds, IT DOES NOT, BY ITSELF, IDENTIFY THE INDIVIDUAL WHO INFLICTED THOSE INJURIES.
Human beings ordinarily interact with family members, friends, colleagues, and other associates. Accordingly, the mere presence of fingerprints, DNA, or other trace evidence on a victim's body is not necessarily determinative of culpability, as such evidence may have an entirely innocent explanation. The recovery and forensic examination of the suspected murder weapon, however, can provide a far more direct evidentiary nexus through fingerprints, DNA, bloodstain patterns, or other forensic characteristics capable of linking or excluding a suspect.
The failure to undertake reasonable investigative steps aimed at locating and examining the alleged murder weapon may reflect shortcomings in the investigation. In criminal justice, incomplete investigations increase the risk of both false convictions and wrongful acquittals because the court is left to determine guilt or innocence without potentially critical physical evidence.
[<b.4>] Why THIS MATTERS:
In “Republic v Joshua Mworia Mwiti [2018] KEHC 1956 (KLR)”, the court emphasized that the prosecution must prove causation beyond reasonable doubt. Without a weapon, without forensic linkage, the chain of causation remains incomplete.
[<b.5>] The CONDOM QUESTION:
At the crime scene where Sharon Belyne Otieno's lifeless body was discovered near Owade River, investigators recovered items that painted a haunting picture of her final moments. Among the clothing, shoes, and sachets of illicit brew were two used condoms and three sachets of Trust condoms. These items were meticulously catalogued by Inspector Mary Mogire (PW18) and produced as evidence before the court.
But what do these condoms truly tell us? This is where the prosecution's case encounters one of its most troubling gaps.
The presence of used condoms at a murder scene where a young woman's body bore multiple stab wounds, including a devastating injury that penetrated her abdomen and pierced her unborn child, strongly suggests one thing:
●○●○●○●○●○●○●○
“SEXUAL ASSAULT”. This was not merely a killing. it was a DEGRADATION, a DESECRATION of the most intimate kind.
●○●○●○●○●○●○●○
But here is where LOGIC COLLIDES with the PROSECUTION'S THEORY.
●○●○●○●○●○●○●○
If Obado was the biological father of Sharon's unborn child as DNA evidence confirmed without question, then he had already achieved the ultimate sexual conquest. He had impregnated her. He had established his dominance. What possible purpose would SEXUAL ASSAULT serve in a scheme to eliminate her?
●○●○●○●○●○●○●○
The question is not rhetorical. It demands an answer that the prosecution never provided.
(-C-) ELEMENT THREE: UNLAWFUL ACT OR OMISSION (ACTUS REUS):
[<c.1>] The LEGAL REQUIREMENT:
Under Section 203 of the Penal Code, for a murder conviction to stand, the prosecution must prove that the death of the deceased resulted from an unlawful act or omission. This is what criminal law scholars call the actus reus, the guilty act. It is the physical element of the crime, the tangible conduct that caused the harm.
The law recognizes that not all deaths are crimes. Some deaths are lawful such as when a person is killed in self-defense, or when a police officer uses reasonable force to prevent a felony, or when a state executes a convict pursuant to a lawful sentence.
Other deaths are accidental, tragic perhaps, but not criminal. A driver who loses control and kills a pedestrian in a genuine accident bears no criminal liability, though civil liability may arise. A doctor who loses a patient despite exercising reasonable care commits no crime.
The prosecution's burden, therefore, is not merely to show that someone died. It must show that the death was unlawful, that it was caused by conduct that the law forbids. The distinction is not academic. It is the difference between a tragic loss and a prosecutable crime.
[<c.2>] What THE PROSECUTION PROVED:
To its credit, the prosecution established the unlawfulness of Sharon's death with relative ease. The evidence painted a picture that no reasonable person could mistake for an accident or a lawful killing.
The testimony of PW9, the journalist who escaped the abduction, provided a harrowing account. He and Sharon were lured to Graca Hotel under the pretext of a meeting with the Governor's representative. Instead of a peaceful resolution, they were forced into a waiting vehicle, driven into the darkness, and subjected to interrogation and violence. The journalist managed to escape, but Sharon was not so fortunate.
When her body was discovered near the Owade River by Moses Onditi Oguta (PW7), the scene spoke for itself. What followed was what the prosecution aptly described as a treasure trove of evidence. No reasonable interpretation of that evidence could support the conclusion that Sharon died of natural causes. Nor could it sustain any suggestion that her death was accidental or the result of lawful self-defense. The evidence established, beyond reasonable doubt, that the body recovered, if indeed it was Sharon's, a matter addressed under Element 1, was the victim of a deliberate and unlawful homicide.
This was the prosecution's victory lap. And it was deserved.
[<c.3>] The GAP:
This was arguably the easiest element to establish. However, proving that a death was unlawful is not the same as proving who caused it. In criminal law, the actus reus must be attributed to the accused. A conviction for murder cannot rest merely on the fact that an unlawful death occurred, it must be supported by credible evidence proving the accused's participation beyond reasonable doubt.
This is the critical gap: Any judge with substantial experience in criminal justice appreciates that motive alone does not identify the perpetrator. There are numerous situations where a victim has multiple adversaries. One adversary may appear to have the strongest and most obvious motive, while another, less visible and perhaps never identified takes advantage of that perception to commit the offence, knowing that suspicion will naturally fall on the more prominent rival. The obvious suspect is not always the guilty party. Everyday experience illustrates this principle, for example:
●○●○●○●○●○●○●○
>>●● There have been instances in which a mother has sought paternity support for the same child from different men who are entirely unknown to each other. The existence of multiple potential fathers demonstrates that the most apparent candidate is not necessarily the correct one.
>>●● Kenya's own history provides another illustration. During the constitutional review period, Dr. Crispin Odhiambo Mbai was widely perceived to have been at odds with the Government led by former President Mwai Kibaki because of his constitutional positions. Many therefore assumed that the Government had the strongest motive to harm him. Yet subsequent investigative reporting including the one by @ntvkenya suggested that another politician may have exploited that prevailing narrative to pursue a personal vendetta, knowing that public suspicion would almost inevitably be directed at the Government.
●○●○●○●○●○●○●○
The lesson is straightforward: “Motive creates suspicion, but suspicion is not proof". Criminal liability cannot be founded on the existence of a plausible motive alone.
[<c.4>] Why THIS MATTERS:
The actus reus must be attributed to the accused persons. Criminal liability is personal. You cannot be convicted of murder simply because you were in the vicinity, or because you knew the victim, or because you had motive, or because you tried to cover something up.

[-4-] >>: WHY THE APPELLATE COURTS MUST ACT — AND ACT SWIFTLY:
☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•
(-A-) THE DOCTRINE OF PRECEDENT AND THE ROLE OF JUDGES:
In Kenya, as in all common law jurisdictions, judges make law. Every judgment of the High Court is binding on subordinate courts. Every Court of Appeal decision binds the High Court.
When a judgment is flawed, the appellate courts have a duty to correct it. Not because they are "pro-accused" or "anti-victim," but because the integrity of the entire system depends on it.
(-B-) THE DANGER OF SHORTCUTS:
If it is that easy to look for a big fish and conclude a significant judgment on account of pinning down the big fish, leaving perpetrators on the streets continuing to be hired as contract killers, then the @Kenyajudiciary will continue delivering mediocre justice in this country.
●○●○●○●○●○●○●○
When investigators take shortcuts, when prosecutors rush to charge, when judges convict on inference rather than proof, the real perpetrators remain at large. And they continue to kill.
●○●○●○●○●○●○●○
Barrister @MigunaMiguna has publicly challenged the conviction, expressing the view that it is unlikely to withstand appellate scrutiny. The defense has already indicated its intention to appeal, arguing that the prosecution did not present evidence directly linking Obado to the crime scene or to the commission of the offence.
[-5-] >>: A CALL TO COMPETENCE — FOR INVESTIGATORS, PROSECUTORS, AND JUDGES:
☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•
(-A-) To INVESTIGATORS:
The crime scene is the silent witness. Treat it with respect. Collect every piece of evidence. Follow every lead. Do not assume guilt before you have proof. In Sharon's case:
[<a.1>] Where is the murder weapon?
[<a.2>] Who were the unidentified men?
[<a.3>] What do the tyre impressions tell us?
[<a.4>] What do the DNA samples from the condoms reveal?
[<a.5>] Why was the tracking device on KCL 481K disabled on the very day of the murder?
These questions must be answered, not assumed away.
(-B-) To PROSECUTORS:
Your duty is not to secure convictions. Your duty is to secure justice. That means presenting evidence that is complete, credible, and capable of withstanding scrutiny.
If you cannot prove all FIVE elements BEYOND REASONABLE DOUBT, do not charge. Do not rely on inference where evidence is required. Do not ask the court to fill gaps that you should have filled during investigation. The prosecution called 42 witnesses and produced 81 exhibits, yet fundamental questions remain unanswered.
(-C-) To JUDGES:
You are the guardians of the Constitution. Article 50(2)(a) guarantees every accused person the right to be presumed innocent until the contrary is proved. That presumption is not a technicality. It is the foundation of our criminal justice system.
When you convict on circumstantial evidence, apply the test from “Sawe v Republic” with rigour. Ask yourself:
●○●○●○●○●○●○●○
"Are the inculpatory facts incompatible with the innocence of the accused? Are they incapable of explanation upon any other reasonable hypothesis such as ours?"
If the answer is "no," you must acquit, no matter how "big" the fish is, no matter how much public pressure is on you, no matter how tragic the victim's story is.
●○●○●○●○●○●○●○
(-D-) The BURDEN OF PROOF AND SPECIAL KNOWLEDGE:
Under Section 111(1) of the Evidence Act, the burden of proving any fact especially within the knowledge of the accused person is upon the accused. In this case, the content and purpose of phone calls between the accused persons on 2, 3, and 4 September 2018 were matters within their special knowledge. The trial court noted that the accused persons did not explain the purpose and content of their communication on those critical days.
But this burden only shifts after the prosecution has established the basic facts. The prosecution must first prove its case, and if it cannot, the accused cannot be convicted simply because they failed to explain something.
(-E-) The INFORMATION AGE AND JUDICIAL COMPETENCE:
We live in the information age. Every judgment is scrutinized, analyzed, and debated, not just by lawyers, but by citizens, journalists, and academics around the world.
When a judgment is flawed, it is not hidden. It is exposed. It is dissected. It is used to question the competence of our @Kenyajudiciary.
The question many people are asking is:
●○●○●○●○●○●○●○
“Why is this judgment likely to be overturned on appeal, resulting in Obado's acquittal?
●○●○●○●○●○●○●○
That is the nightmare scenario. That is what happens when justice is rushed. That is what happens when shortcuts are taken.
But it is not inevitable. The appellate courts can, and must correct the errors of the trial court. They can, and must send a message that the rule of law is not negotiable.
[-6-] >>: CONCLUSION: JUSTICE IS NOT VENGEANCE:
☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•
The murder of Sharon Belyne Otieno was a tragedy. A young woman, pregnant with hope, was brutally killed. Her unborn child never had a chance to draw breath.
The nation demanded justice. And justice was delivered, or so we are told. But justice is not vengeance. Justice is not a conviction at any cost. Justice is the truth, established through evidence, tested through rigorous procedure, and proved beyond reasonable doubt.
If the appellate courts find that:
>>●● The prosecution failed to prove its case.
>>●● That the chain of circumstantial evidence was incomplete.
>>●● That the gaps were too wide.
>>●● That the inference of guilt was not the only reasonable hypothesis.
THEN THEY MUST ACQUIT.
Not because Obado is innocent. But because the state failed to prove him guilty. That is the burden the Constitution places on the prosecution. That is the standard the Penal Code demands. That is the justice that every accused person, no matter how powerful, no matter how unpopular is entitled to.
[-7-] >>: THE EPILOGUE: WE ARE NOT SUPPORTING MURDERERS:
☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•
We are not supporting murderers. We are not defending Obado. We are defending the law.
Because the law is not a weapon to be wielded against the powerful. It is a shield that protects everyone, the weak and the strong, the popular and the despised, the guilty and the innocent.
When the law is compromised, everyone loses.
>>●● The victim's family loses, because the real perpetrators may still be free.
>>●● The accused loses, because they are convicted on insufficient evidence.
>>●● And society loses, because faith in the justice system is eroded.
●○●○●○●○●○●○●○
If Obado indeed pressured Sharon to abort the baby, then at least the courts should be different from Obado and not abort justice. Let us demand better. Let us demand competence. Let us demand that every investigation be thorough, every prosecution be rigorous, and every judgment be anchored in evidence, not inference, not suspicion, not public pressure.
●○●○●○●○●○●○●○
Because justice is not a shortcut. Justice is the long, hard road and it is the only road worth travelling.
<PAGE 3>
African RABBI retweeted
(-D-) ELEMENT FOUR: IDENTITY AND PARTICIPATION OF THE PERPETRATOR:
[<d.1>] The LEGAL REQUIREMENT:
The accused must have committed, aided, procured, or been otherwise legally responsible for the unlawful act. If identity or participation is not proved beyond reasonable doubt, the accused must be ACQUITTED.
[<d.2>] The TRIAL COURT'S FINDING:
The court applied the doctrine of common intention under Section 21 of the Penal Code, which provides that when two or more persons form a common intention to prosecute an unlawful purpose, each is deemed to have committed the offence. The court found that Obado supplied motive and funds, Oyamo operationalized the execution, and Obiero provided logistical support.
[<d.3>] The GAPS, AND THEY ARE MANY:
[<d.3.1>] Obado's Alibi:
Phone records, which the prosecution itself produced as exhibits, showed that Obado was in Nairobi at the time Sharon was abducted and murdered. He had travelled from Migori to Nairobi on 2nd September 2018, a full day before the events at Graca Hotel. The prosecution never placed him at the scene. Not once. Not even close.
The trial court convicted him based on inference, that because he had motive, he must have orchestrated the murder. But motive, however strong, is not evidence of participation. A person can have a motive to kill and yet be completely innocent of the actual killing. The law does not permit conviction on motive alone.
Consider the implications of this reasoning. If motive alone were sufficient for conviction, then every jilted lover, every disgruntled employee, every estranged relative could be convicted of murder simply because they had a reason to wish the victim dead. That is not justice. That is suspicion dressed in judicial robes.
And if Obado indeed bankrolled the execution, the prosecution was obligated to trace the money trail down to the actual perpetrators, the same men whose DNA were found on the condoms at the crime scene. That trail was never followed, and this alone collapses the prosecution's logic.
[<d.3.2>] The Missing Link:
Without getting the murder weapon. Without connecting the murder weapon to the actual perpetrator(s). Without establishing the contact between the perpetrator(s) with Caspal Obiero and therefore Oyamo and Eventually Obado, and without the actual details of what was said on the phone calls, the prosecution and the judge simply engaged on guesswork. This is not an exaggeration. It is a forensic reality. Let us examine each missing link:
>>●● The Murder Weapon: Sharon was killed with a knife, multiple stab wounds, seven deep incisions. Yet the murder weapon was never found. No knife was recovered from the scene. No knife was recovered from the vehicle. No knife was recovered from the homes of the accused. Without the weapon, the prosecution cannot connect the physical act of killing to any of the accused.
>>●● The Perpetrators: The actual killers, the men who abducted Sharon and the journalist, interrogated her, allowed the journalist to escape, stabbed her repeatedly, and discarded her body in the forest were never identified. Not by name. Not by description. Even the journalist who sat beside them in that vehicle could not provide any identifying details. No forensic link, no witness identification, no investigative breakthrough led to these men. The prosecution's case against the accused rests entirely on the premise that these unknown men were acting on their behalf. But that premise was never proven, it was assumed, inferred, guessed. To convict on such a foundation sets a dangerously unacceptable precedent:
●○●○●○●○●○●○●○
That one can be held criminally liable for the acts of complete strangers simply because they shared a motive. The law demands more. Much more.
●○●○●○●○●○●○●○
>>●● The Communication: The phone calls between the accused on 2, 3, and 4 September 2018 were critical pieces of evidence. The trial court noted that the calls were made, five calls between Obado and Obiero on those days. But what was said? The content of the calls was never established. The prosecution never obtained the actual conversations. Without the content, the calls are just numbers on a screen. They prove communication, not conspiracy.
>>●● The Link to Obiero: The prosecution argued that Obiero provided logistical support, using his wife's vehicle for the abduction. But the link between Obiero and the perpetrators was never established. Did Obiero hire the unknown men? Did he communicate with them? Did he direct them? The prosecution could not answer these questions. It simply assumed the link existed.
>>●● The Link to Oyamo: The prosecution argued that Oyamo operationalized the execution, coordinating the events at Graca Hotel. But Oyamo did not enter the vehicle with Sharon and the Journalist. He remained at the petrol station while unknown men took charge, a scenario all too familiar in Kenya, where victims are randomly abducted from entertainment spots without their drinking buddies being implicated. The link between Oyamo and those unknown men was never established. How did they communicate? How did they coordinate? The prosecution offered no answers.
>>●● The Link to Obado: The prosecution argued that Obado supplied motive, instigation, and funds. But the KES 100,000 delivered to Sharon at Graca Hotel was perfectly consistent with Obado's claim that he was supporting her pregnancy. An equally plausible scenario, one the prosecution never addressed, is that independent criminals, aware of the cash, staged a robbery that turned fatal. The prosecution presented no evidence that the money was for murder, no evidence it was paid to the unidentified killers. The alleged pressure to abort occurred months earlier, and the fear of public exposure was never conclusively established, the relationship was already an open secret.
●○●○●○●○●○●○●○
When the links are missing, the chain breaks. And when the chain breaks, the prosecution's case collapses. As the Court of Appeal held in “Sawe v Republic [2003] KLR 364”, circumstantial evidence must form a "chain so complete that there is no escape from the conclusion that the accused person, and nobody else, committed the offence charged." In this case, the chain is not complete. It is full of gaps that the prosecution filled with GUESSWORK.
●○●○●○●○●○●○●○
[<d.3.3>] The "Spiderman" Problem – An Impossible Escape:
The Journalist, PW9 claimed he jumped out of a moving vehicle traveling at 60-80 km/h while sandwiched between two men at the rear seat. He survived with only minor injuries, soft tissue injuries on his hands and knees, according to PW10's treatment notes.
The defense called DW4, Patrick Nganga Mwangi, a motor vehicle assessor with a Diploma in Automotive Engineering and a certificate of proficiency in Insurance. He testified that a passenger of average height with a lean and athletic body jumping from a vehicle moving at 80-100 km/h landing on tarmac would be expected to sustain extensive and severe injuries including fractures or death.
The court dismissed this evidence because DW4 was "not a certified expert on the law of motion." But the court's dismissal raises more questions than it answers. Does one need to be an expert in the "law of motion" to understand basic physics taught in Kenya's High Schools? Does one need to be a physicist to know that jumping from a moving vehicle at highway speed is likely to cause death?
Consider the logistics of the Journalist’s escape.
>>●● He was sandwiched between two men at the rear seat.
>>●● The man seated next to him was strangling him.
>>●● The seat was lowered to an inclined position.
>>●● In those circumstances, the journalist claimed he wiggled his way from his grasp, opened the door, and jumped out of a moving vehicle.
>>●● How did he wiggle free?
>>●● How did he open the door while being strangled?
>>●● How did he escape without the men restraining him or did they just allow him as a friend?
>>●● How did he survive the fall with only minor injuries?
These unanswered questions inevitably invite scrutiny:
●○●○●○●○●○●○●○
Was the journalist a victim, or could he have been something more, was he Sharon's other lover? Was he the actual killer covering up for his unidentified accomplices? The prosecution never answered, and the court never asked.
●○●○●○●○●○●○●○
[<d.3.4>] The Vehicle Identification:
The journalist initially described the vehicle in which he and Sharon were abducted as BLACK. When produced in court, it was GREY, Motor Vehicle Registration No. KCL 481K, a Toyota Fielder.
The court accepted the journalist’s explanation that he saw the vehicle at night, and that grey fits the description of a dark colour and may look like black when viewed in darkness. The court further noted that "it is common knowledge that a vehicle is identified through its registration number and not through its colour."
But this explanation is not as comforting as the court suggests. If the vehicle is identified through its registration number, then why did the journalist not mention the registration number? Why was the registration number not part of his initial description? The registration number was the single most important piece of information that could have identified the vehicle. Yet the journalist never provided it at the first instance.
Moreover, the court's reasoning assumes that GREY can look like BLACK in darkness. But the vehicle was not parked in total darkness, it was outside Graca Hotel, which is a commercial establishment. There was likely ambient light. And the journalist was not driving. He was a passenger. He had the opportunity to observe the vehicles. He could perform the impossible, jumping from a high-speed vehicle yet couldn't manage the simple task of identifying a colour correctly?
This discrepancy is another link in a chain of inconsistencies that should have raised reasonable doubt.
[<d.4>] Why THIS MATTERS:
The Court of Appeal in “Sawe v Republic [2003] KLR 364” established a test that has become the gold standard for evaluating circumstantial evidence in Kenyan criminal jurisprudence. The court held that for circumstantial evidence to sustain a conviction:
●○●○●○●○●○●○●○
The inference of guilt, the inculpatory facts must be INCOMPATIBLE with the INNOCENCE of the accused, and incapable of explanation upon any other reasonable hypothesis than that of his guilt."
●○●○●○●○●○●○●○
This is not mere rhetoric. It is a rigorous, demanding standard. It requires the prosecution to do more than raise suspicion. It requires the prosecution to eliminate all reasonable doubt. It requires the evidence to point so inexorably to the accused that no other conclusion is possible.
Are the facts in this case truly "incompatible with innocence"? Or are they merely consistent with guilt? There is a profound difference.
(-E-) ELEMENT FIVE: MALICE AFORETHOUGHT (MENS REA):
[<e.1>] The LEGAL REQUIREMENT:
Under Section 206 of the Penal Code, malice aforethought is established by proving:
>>●● Intention to cause death or grievous harm.
>>●● Knowledge that the act will probably cause death or grievous harm.
>>●● Intent to commit a felony or
>>●● Intent to facilitate escape from custody.
[<e.2>] The TRIAL COURT'S FINDING:
The court found that the accused persons acted with malice aforethought, inferred from the planning, preparation, and brutal execution of the murder. The judge held that:
●○●○●○●○●○●○●○
Obado had "a very strong motive to unlawfully end Sharon's life to ensure that his illicit affair with her was not widely publicized through the print media in order to save himself from possible public embarrassment and reputational harm and to safeguard his political standing".
●○●○●○●○●○●○●○
[<e.3>] The GAP—THE SOCIOLOGICAL ARGUMENT:
Sharon's murder was brutal, multiple stab wounds, sexual assault, a foetus stabbed through the mother's abdomen. This was not a crime of passion. It was a crime of calculated cruelty. SOCIOLOGISTS AND CRIMINOLOGISTS have long observed patterns in intimate-partner homicides.
>>●● The primary reason MEN kill WOMEN in intimate partnership environments is JEALOUSY AND POSSESSIVENESS, that is, when a MAN'S SEXUAL EMPIRE IS THREATENED.
>>●● The primary reason WOMEN kill MEN in such environments is FINANCIAL GAIN, that is, when a WOMAN'S FINANCIAL EMPIRE IS THREATENED.
When a murder is sadistically executed with an extreme torture ingredient:
>>●● If committed by MEN, they will be personally involved because they want to see their victim suffer.
>>●● If committed by a WOMAN, she will hire others (CONTRACT KILLING) and give sadistic instructions because she does not want to see the torture but will possess the ultimate male offender with financial and sexual promises.
Sharon's murder was a classic example of CONTRACT KILLING, brutal, detached, executed by unknown men. Who benefits from such cruelty between a MAN and a WOMAN? Who had the motive?
[<e.4>] The LUO ANALOGY:
Obado is a Luo man, and an understanding of the social and cultural dynamics commonly associated with Luo society is instructive.
●○●○●○●○●○●○●○
Within the socio-cultural context of Kenya, a Luo man is traditionally characterized by his ability to maintain multiple relationships with grace and equanimity, managing a network of partners and their children without resorting to violence.
●○●○●○●○●○●○●○
Former nominated Senator @gloria_orwoba once shared her personal experience of having a Luo ex-husband, describing it as a BADGE OF HONOR to have been shaped by what she termed the "University of Character Development" under a Luo man as the Don. According to Orwoba, a relationship with a Luo man leaves one with lessons on LOVE and HEARTBREAK in equal measure, experiences she argued prepare a woman to face the future with resilience.
Obado, being a known grandson of Sinakuru Kuku Lubanga, had relationships with several women and had documented children with more than one woman. In fact, most of his alleged corruption proceeds were in the names of his children. Obado could therefore be argued that”
●○●○●○●○●○●○●○
Being a Luo and above all having documented children from various relationships with women, he couldn't be threatened by either a woman, a child from that woman, or distribution of wealth to all his children including the new unborn child by Sharon.
●○●○●○●○●○●○●○
The question that many people have been asking: Who, between Obado and his wives could reasonably be threatened by the person of Sharon Otieno and the unborn child and could harbor such a sadistic motive? Because Obado has all the track records with more than one woman, first as Luo and second as Obado, and with children from different women, but murder?
[<e.5>] Why THIS MATTERS:
Malice aforethought is a state of mind. It must be proved, not assumed. If there is another reasonable hypothesis, that the murder was committed by someone else, for different reasons, then the prosecution has not proved malice aforethought beyond reasonable doubt.
[-3-] >>: THE CRIME SCENE — THE SILENT WITNESS THAT WAS SILENCED:
☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•☆•
Every homicide investigation begins at the crime scene. It is the "silent witness", the one piece of evidence that never lies, never forgets, and never changes its story. In Sharon Otieno's case, the prosecution's approach to this silent witness raises more questions than it answers.
(-A-) WHAT THE JUDGMENT SAYS HAPPENED AT THE CRIME SCENE:
The trial court heard that Sharon's body was discovered on 4th September 2018 by Moses Onditi Oguta (PW7), a resident of Owade village, who was shepherding his cattle when he stumbled upon it. The body lay in a pool of blood in a thicket at Owade village, Rachuonyo South Sub-county in Homa Bay County. Police documented the scene extensively, or so they said, with crime scene investigation officer LILLIAN SAKA testifying that she took a total of 29 photographs at Kodera Forest, documenting a pool of blood, a shoe impression, a condom wrapper, and a bottle top.
The items recovered at the scene included clothing and open shoes belonging to Sharon, two used condoms, three sachets of Trust condoms, two cover packets of Trust condoms, and a sachet of Simba Warigi (illicit brew).
(-B-) WHAT THE FACTS ACTUALLY TELL US — AND WHAT THEY DON'T:
[<b.1>] The Condom Evidence: A MISSED OPPORTUNITY?
Two used condoms were discovered at the crime scene. In any murder investigation, such evidence would be treated as gold. Condoms are biological evidence containers, they can yield DNA profiles of perpetrators, establish whether sexual assault occurred, and potentially identify the assailants.
Yet when defense counsel, the 10 KILO lawyer, SC @kiokokilukumi asked crime scene investigator Lillian Saka whether fingerprints were lifted from the condom wrapper, her response was damning:
●○●○●○●○●○●○●○
"No, they were not, my lady".
●○●○●○●○●○●○●○
When pressed on why such a basic forensic procedure was omitted in such a serious crime, Lilian Saka replied:
●○●○●○●○●○●○●○
"The exhibits were not recovered from me. This was a crime scene I was attending two days after it had happened. I was not the first officer at the scene".
●○●○●○●○●○●○●○
This is deeply troubling. If the crime scene was not properly preserved in the critical hours immediately following the murder, if the first officers on the scene failed to secure and properly document biological evidence, then the prosecution's case rests on a foundation that is fundamentally compromised.
What exactly were the first officers doing at the crime scene if not collecting evidence? Did they go there to secure the scene for the actual perpetrators rather than for justice?
[<b.2>] The Shoe Impression: ANOTHER MISSED OPPORTUNITY?
A shoe impression was discovered and catalogued by Investigator Lillian Saka at Kodera Forest for a good Reason. Shoeprint evidence was to be crucial in identifying perpetrators, matching the unique wear patterns, tread design, and size of a shoe to a specific individual. Yet when asked why she failed to do a cast impression, Saka replied:
●○●○●○●○●○●○●○
"Cast impressions are usually done for clear shoe prints. In this case, it was not clear enough. That is why I took a photograph and left it at that".
●○●○●○●○●○●○●○
This explanation is INADEQUATE. If the impression was not clear enough for a cast, why was it considered significant enough to photograph? And if it was photographed, why was it not subjected to further forensic analysis? The court was left with a photograph of an impression that could have belonged to anyone, a rescuer, a police officer, a passerby, OR A KILLER.
[<b.2>] The Vehicle: IDENTIFIED BUT NOT FORENSICALLY LINKED?
The vehicle used in the abduction was a grey Toyota Fielder, registration number KCL 481K. It was owned by Olivia Oloo, the third accused's wife, and operated as a taxi by Jackson Otieno Gombe (PW38). The vehicle was identified, recovered, and produced in court as an exhibit. On paper, this appears to be a significant piece of evidence. But paper is not proof.
Critical questions remain unanswered, questions that should have been answered before any charge was preferred, let alone a conviction secured.
[<b.2.1>] Tyre Impressions: The Evidence That Never Was?
Tyre impressions at the crime scene could have matched the vehicle's tyres to the scene, establishing an irrefutable connection and proving definitively that KCL 481K was present at the location where Sharon's body was dumped. Forensic tyre impression analysis is a well-established science, it falls under pattern evidence and is rooted in Locard's Exchange Principle:
●○●○●○●○●○●○●○
The vehicle transfers its unique tread characteristics onto the substrate, or vice versa. A questioned impression from a scene can be compared against a known standard from a suspect vehicle.
●○●○●○●○●○●○●○
Yet this evidence was either not collected or not presented. The crime scene investigator, Lillian Saka, admitted she arrived two days after the murder. By then, the scene had been compromised by earlier officers? If tyre impressions existed, they were either not collected or not presented. The prosecution cannot rely on the mere fact that a vehicle was identified by an inconsistent witness, Kenya does not recognize HEARSAY as a substitute for forensic proof. A tyre impression conclusively connected to the vehicle would have been infinitely stronger than the mere assertion that KCL 481K was the vessel of transportation.
[<b.2.2>] The Tracking Device: A MYSTERY WRAPPED IN SUSPICION.
The tracking device fixed in the vehicle was inactive on 3rd September 2018 and reactivated on 4th September 2018. The @ODPP_KE at the time described this as "a well-calculated move to conceal the movement of the vehicle in question". The lead investigator, Nicholas Ole Sena, told the court that the tracker was working on 2nd September but tampered with on 3rd September, the day Sharon was murdered.
But here is where the prosecution's case begins to unravel. Tampering with a tracking device is conduct consistent with concealment, but who tampered with it? And when? These are not academic questions. They are the very questions that separate proof from suspicion.
The prosecution never established who tampered with the device or when. The tracking company, Qool Point Services, through its administrator Fatma Khalid, testified that the device was inactive on the material day and reactivated the following day. But she also acknowledged that tampering with the tracking device could not be detected on the system if its SIM card simply lacked credit. In other words, the inactivity could have been caused by something as mundane as an expired airtime balance, not by a sinister hand.
[<b.2.3>] The DATA TRAIL THAT WAS NEVER FOLLOWED.
Service providers maintain detailed data trails. Every activation, every deactivation, every ping from a tracking device leaves a digital footprint. With a court order, investigators could have obtained records showing exactly when the device was deactivated, by whom, and through what means. They could have determined whether the SIM card had credit or whether it had been physically tampered with.
Why didn't the prosecution pursue this? Investigators routinely make informal inquiries with Safaricom and other providers, it has always been alleged that such "off-the-record" checks are common practice. Yet in this case, the prosecution chose not to establish definitively whether the tracking device was tampered with or simply ran out of credit. They chose not to identify who tampered with it. They chose not to prove concealment.
Instead, they asked the court to infer tampering from the mere fact of inactivity. INFERENCE IS NOT EVIDENCE. SUSPICION IS NOT PROOF.
The prosecution's failure to follow the data trail leaves a gaping hole in their case. If the tracking device was tampered with, who did it?
>>●● The driver, Jackson Gombe?
>>●● The third accused, Caspal Obiero?
>>●● The "Superman Journalist" who escaped from a moving vehicle while sandwiched between two assailants?
>>●● Or Someone else entirely?
If the device simply lacked credit, then the entire theory of calculated concealment collapses. These questions are not meant to be facetious. They are meant to highlight the absurdity of a prosecution that asks the court to accept EXTRAORDINARY CLAIMS without EXTRAORDINARY PROOF.
