Kinda wonder, if the Supreme Court were to overturn Bivens entirely in Nielsen v. Wantanabe, could that combined with the new Congress help trigger legislation finally creating a statutory remedy?

I doubt Prof Blackman & I define "conservative" & "right of center" the same way each other do. I'll just say, as I often do, that I consider myself right of the median law prof & left of the median Scalia clerk. Which yes, includes a wide swath of the ideological spectrum. GOOD.

The setting for this morning’s argument before the Colorado Suprrme Court. It was a complete treat to argue in front of a room of very engaged high school students. Other courts (including, dare I say it, federal courts) should do this too.
