The ACO will always control the Le Mans BoP because Le Mans is their event and the BoP has to cover every manufacturer fairly under the WEC/Hypercar regulations.
It’s not “ACO picking who they like” — the ACO, with the FIA/WEC, uses the agreed BoP process to balance cars based on data and performance. Le Mans is also unique, so its BoP is specifically calculated for the Circuit de la Sarthe rather than simply copying the normal WEC settings.
Basically: if you enter Le Mans, you enter under the ACO/FIA WEC regulations — including their BoP. That’s how you get multiple manufacturers racing each other on broadly equal terms.

That’s not how garage 56 works….. Garage 56 isn’t a spare Le Mans ticket for famous drivers. It’s an ACO-selected experimental-car programme. Max couldn’t simply choose Garage 56 and enter Le Mans; he’d need to be driving for a competitor whose genuinely innovative car/project had first been selected by the ACO, and the car would run outside the official classification
