United States (1957), SCOTUS ruled obscenity isn’t protected by the First Amendment. Later in 1973, Miller v. California, SCOTUS introduced the three-prong “Miller test” for obscenity: 1 whether the average person would find it appeals to prurient interest 2 whether it depicts sexual conduct in a patently offensive way 3 whether it lacks serious literary, artistic, political, or scientific value. Material failing this test is unprotected and can be banned.
