ALT We are disappointed with the decision that allows sentencing proceedings to continue even after they have become unconstitutional. Courts, more than any other institution, should respect constitutional rights. Even though our client’s year-long sentencing process violated his right to be tried in a reasonable time, the court permitted the process to continue – making the illegal delay even longer. The justice system is overloaded and cases take far too long. That is not a reason to abandon the Charter right to trial within a reasonable time. Allowing cases to drag on past the point of unreasonable delay will not fix the system, but it could make it worse. For the Appellant, this means that he now stands to be deported to Iran, a country affected by war and authoritarianism, just as the Canadian government warns against all travel there. We call on the authorities to halt his deportation in these circumstances. - Arash Ghiassi and Julia Kirby

ALT Today, Aubrey Cottle formally accepted responsibility for his role in hacking a Texas Republican Party website in 2021. He pleaded guilty before a Canadian court and will be sentenced by a Canadian judge. US federal prosecutors have charged Mr. Cottle for the same conduct in Texas. As a matter of fairness, that charge should now be withdrawn. No one should be prosecuted or punished twice for the same conduct. In the event of an extradition request, Canada should do the right thing and refuse to extradite Mr. Cottle. The Carney government must protect the integrity of our legal system and stand up to Trump’s lawless administration. Riaz Sayani and Arash Ghiassi
