The Madras High Court has rejected a mother's claim over her deceased son's estate based on a Will excluding his wife, despite a forensic report finding no signs of manipulation in a supporting video recording.
The man, who was suffering from colon cancer, died in March 2014. His mother relied on a Will allegedly executed during his hospitalisation, leaving his property to her instead of his widow.
The widow challenged the Will, raising questions about her husband's medical condition, the circumstances of its execution and the use of a thumb impression instead of a signature.
The High Court observed that an authentic video recording does not automatically establish that a person understood the contents and legal consequences of a Will or executed it voluntarily. It found that the suspicious circumstances surrounding the document had not been satisfactorily explained.
Accordingly, the Court rejected the Will and recognised the widow's entitlement to half of her husband's remaining estate. However, it upheld a separate registered settlement deed through which the deceased had transferred certain property to his mother during his lifetime.
