The Intersection of Between Public Procurement and B-BBEE
By Eustace Mashimbye, Chief Executive Officer @ProudlySA
The landmark ruling by the Constitutional Court that declared the country’s procurement regulations, specifically the Preferential Procurement Regulations 2017, to be invalid and inconsistent with the Preferential Procurement Policy Framework Act (PPPFA), has inadvertently dealt a severe blow to efforts aimed at leveraging the state's massive procurement war chest to drive local procurement and accelerate industrialisation in the designated economic sectors already earmarked for preferential procurement.
While admittedly this momentous verdict was precipitated by the inclusion of pre-qualification criteria as outlined in the Broad-based Black Economic Empowerment Act, we hope that the inclusion of local procurement in any request for quotations (RFQ) would provide impetus to the scaling up of local industries down the value chain and accelerate the inclusion of home-grown companies in the state’s supply chain.

B-BBEE Landscape Evolution: An Opportunity For Economic Inclusion 🇿🇦
✍️ By Livhuhani Mukhithi, Director: B-BBEE Policy, Advocacy & Institutional Management, @the_dtic
The evolution of B-BBEE policy, legislative framework and institutional mechanisms has largely been triggered by the continuous test of its efficacy in the face of unrelenting scrutiny and opposition to its implementation. With the early iteration of BEE in the 1990s and early 2000s premised largely on ownership acquisition, was this focus not narrow and limited to the ideal of economic redistribution and inclusion. The gravitation towards Broad-Based BEE proved that fundamental transformation of the patterns of ownership of the mainstream of the country’s economy was necessary.
This change of approach appreciated the power of elements such as Management Control, Skills Development and Enterprise and Supplier Development (ESD). Also contained in these changes was the codification of these elements to enable measurement of contribution by mainstream economic actors to the noble idea of economic transformation. The Amended Broad-Based Black Economic Empowerment (B-BBEE) Codes of Good Practice of 2013, which became effective in 2015, introduced a new scorecard that had five elements: ownership, management control, skills development, enterprise and supplier development (ESD) and socio-economic development.

Employment Equity Compliance: Enforcement Is Here - Is Your Business Inspection-ready?
✍️ By Frik Boonzaaier, Human Capital Transformation Specialist @TheBEEChamber
South Africa’s first reporting cycle under the amended Employment Equity Act, now incorporating sectoral numerical targets, has officially closed. This signals the beginning of a significantly intensified enforcement period for employers across the country.
The Department of Employment and Labour (DEL) has been explicit: additional inspectors are actively being trained, which means the chance of a compliance inspection has risen sharply. When an inspection takes place, failure to comply will carry heavy consequences. Fines for initial contraventions begin at R1.5-million per offence and can climb as high as 2% of annual turnover.

The Transformation Fund: Revisiting The Historical Problem of Access to Capital For Black Businesses 💰🇿🇦
✍️ By Tshediso Matona, B-BBEE Commissioner
South Africa’s democratic transition was not only a political project, it was also an economic one. The promise of democracy carried with it the expectation that millions of black South Africans, long excluded from meaningful participation in the economy, would finally gain access to opportunities, ownership, finance, and productive economic activity. More than three decades later, the question of economic transformation remains one of the defining issues of our national discourse.
This 25th edition of Impumelelo: Top Empowerment Companies provides an important opportunity to reflect on the progress made, the challenges that remain, and the work still required to build a more inclusive and equitable economy. It is fitting that this milestone edition is launched at a time when South Africa is once again engaged in a robust debate about the future of economic transformation and the instruments required to deepen inclusion.

We must put data over decorum and measure real outcomes like jobs created if we want to build legacies instead of burning capital. #BafanaPride #NedbankTopEmpowerment #TopcoMedia

100%. Without verified baselines, it’s just a budget line item. Data over decorum. If we can't measure the jobs, we're just burning capital, not building legacies.#BafanaPride #NedbankTopEmpowerment #TopcoMedia
