Two reasons the spoliation instruction will be denied: No proof of "bad faith" or intentional sabotage: The defense has to prove that law enforcement intentionally destroyed the evidence to hide something. The testimony was the hard drive crashed so it doesn't meet the high legal bar to give the instruction. The federal investigation was separate. The defense wants to blame federal prosecutors for mistakes made during the initial state police investigation. But the government has built its an independent case using separate FBI forensic data and will argue they cannot be legally penalized for a state agency's mistakes via a spoliation instruction.

Well, THIS is embarrassing… 😂 Last night’s show was a success, and the Anti-Turtleboy, “Turtleboy = BAD” crowd’s big comeback is… to scour photos of attendees and play FASHION POLICE?! Mocking people’s appearances, outfits, and personal style? THAT’S the best they’ve got?! REALLY?! And let’s not forget the self-appointed legal scholars predicting Katy Perry and her team will be coming after Aidan for performing a PARODY song at a private event that wasn’t televised, livestreamed, or officially recorded. Just a handful of unauthorized videos taken by attendees who were explicitly told recording wasn’t permitted. So, let me get this straight. When you can’t criticize the show’s success, you resort to mocking the audience and fantasizing about lawsuits? The show was a HIT. The backlash is a FLOP. And the COPE? Absolutely OFF THE CHARTS! 😎🍿

💥I hope the O’Keefe & Birchmore cases have opened the eyes of the citizens of Massachusetts. The Feds cannot be trusted and they do not GAF about “justice.” 💥They’re only prosecuting Farwell because Levy forced their hand by arresting him. Look how they’re protecting Fanning & Tully. 💥The Feds work against the interest of the people, not for the people. They exist to protect corruption, not to route it out.

Aidan reading Grant's texts from the Farwell Trial, having absolutely no idea what they mean, or what's going on, is next level low-IQ. No wonder Karen had to feed him all the evidence in her trial. Dude couldn't find his way out of a wet paper bag.

"Do those terms mean the same as partial vs fully suspended hangings?" "Yes." "What are the sub categories of incomplete hangings?" "Sure, sometimes your feet are in contact with the floor, sometimes your knees, sometimes your bottom, or butt, or are you laying down. Depending upon how much of your body is in contact with the floor will dictate how much force is exerted on the ligature around your neck." "In some instances toes or buttock can be on the ground?" "Yes, and that is important to know because I look at how much pressure was put on the neck. To know if it's a homicide, suicide or staged scene, that is something I need to know."

The medical examiner should be fired and charged. What a shame and disgrace. Why the heck she came to a conclusion about cause of death without key evidence. She failed Sandra.

"Enough force was applied to Ms. Birchmore's neck," Smock testified, to cause bleeding below the ligature. Likely by "squeezing pressure"

Sending the Hyoid bone to a specialist for further review is an interesting wrinkle. We'll learn after lunch the result. But so far, Dr. Smock has gutted Dr. Capo-Martinez incompetent work.

Here we go. Judge takes the bench. "Counsel, a few housekeeping things; exhibit 160, which was the marriage certificate, I looked at rule 803 (9), a public record of a vital statistic, so I think there is a basis for admission." "Thank you, your honor." "As to the continued testimony of Mr. William Farwell, I thought further about what the government is proposing. I will allow that limited questioning under 404 (b), in regards to questions about non-disclosure of the relationship with Ms. Birchmore as opposed to disclosure of other relationships (affairs), and to the extent that there are observations of Mr. William Farwell of Mr. Matthew Farwell with the other individuals, I will allow that. I understand the objections Ms. Stevens, and they are noted on the record. I will give a limiting instruction to the jurors about 404 (b) evidence, as I did before."

Dear @FBI, I just watched The Wolves of Real Estate: The Alexander Brothers on @peacock. I am in it. You know my part. I was asked to gather intelligence on Evan Torgan, the attorney representing the women who came forward against the Alexander brothers, and to work against his clients. I said no. I protected the women’s lawyer. I protected the women. And I brought what I had to you. I knew the women were being targeted. I did not know the full extent of it until tonight. What the film describes is very serious witness intimidation and the targeting of victims using PR firms and private investigators. They were intimidated. They were targeted. And on camera, the people who did it said the women bore responsibility for what happened to them. I watched it twice to make sure I heard it right. I did. That is wrong. I am asking you to investigate the investigators and the PR firm that did this. Not because I am angry, although I am. Because going after witnesses is not crisis management. It is a second crime committed against people who had already survived the first one. These women did their part. They spoke. They trusted that if they told the truth, someone would stand in front of them. I did. Now I am asking you to. Everyone who engaged in witness intimidation and the targeting of these women and their lawyer should be held accountable and should have to answer for their actions. You have the authority to make that happen. Please use it. I can look myself in the mirror because I turned down the money and stood with the victims. The people who took the money and went after them cannot say the same. They took a paycheck to make women who had already been hurt afraid to speak. That is not a job. That is a choice, and they should have to answer for it. Everett A. Stern HSBC Whistleblower Founder and Intelligence Director, Tactical Rabbit

Wow! Maurene Comey, the former federal prosecutor behind some BIG cases, including Epstein, Maxwell and Diddy, has been awarded retroactive reinstatement and backpay after a judge ruled her firing was illegal!!!! Going through this 55-page ruling now…the DOJ admitted Comey wasn’t fired for poor performance or misconduct. In fact, she had just agreed to join another major prosecution team hours before she was fired by email. The government later claimed Pam Bondi ordered her firing and Todd Blanche signed off on it afterward. The judge rejected that defense, ruling that neither could get around federal employment protections. Comey also alleges she was targeted because of her father, former FBI Director James Comey. That hasn’t been proven, but the judge has now ruled her firing was illegal.
BREAKING: A federal judge has ruled that the Trump administration unlawfully fired Maurene Comey, the former SDNY prosecutor who worked on the Epstein, Maxwell and Diddy cases. In a 55-page ruling, Judge Jesse Furman rejected DOJ’s constitutional defense of her firing, ordering retroactive reinstatement and backpay. Comey, daughter of former FBI Director James Comey, was fired in July 2025 without notice or explanation. The judge found that DOJ violated federal civil service law and her due process rights. Her separate political retaliation claim remains unresolved.

Billy Farwell leaves Boston federal court after his brief testimony given under a federal immunity deal to avoid charges of having sex with Sandra Birchmore while on duty. His twin brother Matt glanced up and then stared straight ahead as his brother described his own affair with Sandra Birchmore beginning in 2018. He testified that he did not know about Sandra‘s relationship with his twin at the time.

Melanie Little to Chris Mattei on being described in his filing as a paid “social media blogger.” “That’s Attorney Melanie Little to you, sir. No matter how much you try and shut me up, John O’Keefe was still not hit by a car, so good luck with that.” “WHO’S PAYING FOR THIS?” Chris Mattei, perhaps you should advise your clients to take a closer look at Michael Proctor, Brian Tully, John Fanning, and Michael Morrissey, and their botched investigations. There seems to be a pattern of looking the other way when it comes to their “friend” cops. Blaming those who point out the obvious will result in you looking like a fool the way Hank Brennan did.

Matt Farwell is so stupid he didn’t send texts from Sandra’s phone after he killed her. She texted people constantly. He didn’t take her laptop and destroy it. This dude thought he was untouchable. @FBIBoston and @DOJCrimDiv getting clowned by these incestuous dumbasses.

I'm onto you, Brian Tully, John Fanning and KP. You can expect even more reports going forward, even more livestreams, even more posts and even earlier court arrivals. You come heavy or you don't come at all, you cowards. How dare you interfere with a federal investigation.
As a message to all colleagues, and friends who follow this feed, please do not promote or otherwise engage with any coverage of this case from anyone who started covering the trial mid-way through. Thank you. I have grave concerns. Grave, grave concerns.
