Former President Trump pleads not guilty to 34 charges of felony falsifying business records related to alleged hush money payments.
As discussed with Derrick Hogan of @TullyLegal falsifying business records (a misdemeanor on its own) can be elevated to a felony “Only if a person guilty of falsifying business records in the second degree (misdemeanor) is found to have committed that crime with intent to commit another crime or to aid or conceal the commission thereof.”
It’s considered rare but not unprecedented. In the clip below Mr. Hogan explains the legal argument.
We haven’t seen the details of the indictment of former President #Trump but based on what’s being reported, the #Manhattan DA is elevating what critics see as misdemeanor “falsifying business records” charges into a felony.
