$44,000 can change the equation for a family trying to buy a home. Our lawsuit alleges that one energy mandate contained in Minnesota’s 2024 omnibus law could add at least that much to the cost of a new two-story home with no prior scrutiny. KLGR takes a closer look at the case and what’s at stake for Minnesota builders and homebuyers: myklgr.com/local-news/24-omn…

At the United States Court of Appeals for the Eighth Circuit today: UMLC Senior Appellate Counsel Nick Nelson argued on behalf of Pollyann Sorcan in her First Amendment case against Rock Ridge School District. The case centers on whether the district retaliated against Sorcan, an elected school board member, for speaking out on matters of public concern. UMLC is proud to continue defending her free speech rights and holding government accountable.

This case is bigger than one industry. It’s about how laws are made. “Builders and small businesses should not be subject to sweeping regulations enacted through an unconstitutional process,” said UMLC President Doug Seaton. UMLC is asking the court to enforce the constitutional limits placed on the Legislature. Read more about the case: umlc.org/minnesota-builders-…

UMLC Senior Appellate Counsel Nicholas Nelson explains why bundling sweeping, unrelated provisions into one massive bill raises a constitutional problem. umlc.org/minnesota-builders-…

As UMLC Senior Appellate Counsel Nicholas Nelson said, when the government threatens someone’s career and livelihood over constitutionally protected criticism, it should have to answer for it in court. That is exactly what the Eighth Circuit’s decision allows Dr. Scott Jensen’s case to do. Catch up on the latest here: umlc.org/dr-scott-jensens-fr…

Can a school board punish one of its own members for asking tough questions? That is the issue in UMLC’s First Amendment case on behalf of Pollyann Sorcan, a former Rock Ridge School Board member who says ISD 2909 censured her, stripped her of committee assignments, and tried to block her from attending committee meetings after she questioned board policies. The Eighth Circuit ruled in Sorcan’s favor and reversed the lower court’s dismissal. Now, the case is back in district court for the next steps. UMLC Senior Appellate Counsel Nicholas Nelson will appear at the next hearing on October 22. Elected officials do not lose their First Amendment rights when they take office.
