Oscar Belgal lost his bid to get released from ICE custody on emergency medical grounds.
"Petitioner does not show signs of a deteriorating condition," ruled a federal judge.
Belgal could still later be released on his habeas petition, but for now he'll stay locked up at MDC.
ICE says it can’t dim the lights at 26 Federal Plaza or give detainees pillows.
“Pillows are a security risk.”
A judge ordered ICE to do both after a trial revealed many detainees spent days at a time in the building’s holding cells. ICE now wants a new trial.

New: Oscar Belgal filed a new release petition in Brooklyn. He says ICE never ID’d themselves before shooting.
“It wasn't until later, when Oscar woke up in the hospital with one of their bullets lodged in his neck, that the individuals would declare themselves as ICE officers.”
Update: Oscar Belgal, the man shot by ICE in New York City yesterday, has been located by his legal team.
He still has the bullet lodged in his body.
He's currently at MDC Brooklyn. ICE drove him to NJ last night, then brought him back to NYC today.
