This partnership took about a year to close and 2 months to implement through a dedicated team effort. • Individual Right of Access is being strictly enforced—delays or unreasonable barriers by providers can now lead to OCR penalties.
• The Information Blocking Rule prohibits healthcare entities from interfering with access, exchange, or use of electronic health information (EHI)—this includes records requests from authorized legal representatives.
• Designated Record Set vs. EHI—know the difference and how it affects your request strategy.
• HIPAA-covered entities must respond to access requests within 30 days, with limited extensions.
