If true, this is heinous and illegal. You do not kill helpless survivors of a sinking boat. (It enraged us when, for example, the Japanese would machine-gun American survivors in the water.) You do not kill someone who is hors de combat, and no quarter orders are flatly illegal.

In their Article, @fredosmithjr & Peter O’Neill reconstruct the story of Younger v. Harris. Relying on diverse sources, their Article democratizes our constitutional memory and recovers the erased history of Black political resistance and state oppression underlying Younger.

Political violence from any party or any ideology is a direct assault on the foundations of democracy and the rule of law; it seeks not to persuade but to intimidate, not to debate but to destroy. In every instance it corrodes the public trust, diminishes our shared institutions, and replaces reasoned discourse with fear and coercion. Whatever our differences, they must be resolved through the peaceful exchange of ideas, the ballot box, and the institutions that safeguard our freedoms, not through threats, intimidation, or bloodshed.

Colorblindness for thee but not for me. Oof
BREAKING: The Supreme Court — over the objection of Justices Sotomayor, Kagan, and Jackson — allows the Trump administration’s racial profiling of people working certain types of jobs in its immigration raids during litigation.

Richard Fallon’s passing is a tremendous loss for the field of federal courts and the academy. He exemplified academic integrity, mentorship, and brilliant insights that commanded attention across ideological lines. He has been a model, inspiration, and guide.

After ten years, today is my last day as a professor at Emory Law. It's bittersweet, given my exceptional colleagues and students, and the ways I grew as a scholar here. And still, I am very excited about the next chapter as a professor at my alma mater, Stanford Law School.

Thrilled that my new article, "The Forgotten Face of 'Our Federalism,'" will appear in @YaleLJournal. With co-author Peter O'Neill, we tell the forgotten racialized origins of the canonical Younger v. Harris. A new framework contextualizes this forgetting: legitimacy laundering.

Wow. So grateful for this glowing review of Deadlock from Variety & @bristei: "TV’s newest political potboiler is more erudite than 'The West Wing' and more intense than '24' — and it’s coming to, of all places, PBS." The show premieres tmrw night! variety.com/2024/tv/news/pbs…

Trump claims that no court was willing to look at the merits of his election fraud claim, and that he only lost on standing. Not so. Here's the Third Circuit's ruling by Judge Bibas, an appointee of Donald Trump. www2.ca3.uscourts.gov/opinar…

Over the years I've made a checklist for writing law review introductions. Just my two cents but I've been told it can be helpful. Stuff insiders know that's hard for outsiders to learn. Now sharing for accessibility's sake, please feel free to pass on: scholarblogs.emory.edu/profl…

A visionary, transformative servant-leader and mentor. A heartbreaking loss.
Rest in power Chris Edley. He served as @UCBerkeley interim School of Education Dean 2021-23. He encouraged us everyday to educate like democracy depends on it.
