Interesting thread here from Orin about some remarks by Justice Kavanaugh. I’m disappointed (but unsurprised) to hear that the Court sees its job as providing clear & administrable rules, and that it declines to hear cases when it’s unlikely to generate such rules …..
Replying to @OrinKerr
Second, he had some interesting speculation about why the Court is taking fewer cases. One thing he said was that the Justices discuss at conference whether they will be able to clear up an area. A split may be confusing, but if they take it up, they may not reach a clear rule.

BioLawLapalooza 5.0 group photo! Like the idiot I am, I forgot to have us take it on Friday, when more people were here, but it's great to have this. The best thing @StanfordCLB does, bringing together great people to build a field, a community...or a family.

Seeing a lot of responses along the lines of: Memphis PD implemented various reforms. Those didn't prevent Tyre Nichols's death. Therefore, those reforms have failed. A few thoughts: 1. We don't know that these reforms were implemented in any real way. Indeed, it looks ...
