My thoughts on the recent decision of the UK Information Commissioner to reprimand the Department for Education, instead of issuing a £10m fine excellolaw.co.uk/excellolaw-…

There are genuine questions about how best to enforce data protection law in the public sector, but this looks suspiciously like letting them off the hook
But for the ICO’s new policy of leniency towards the public sector, DfE could have been fined £10 million. Is a reprimand really appropriate?
Today we issued the Department for Education with a reprimand following the prolonged misuse of the personal information of up to 28 million children and a failure to do due diligence on who could access pupils’ learning records. More: ico.org.uk/about-the-ico/med…

ICO has agreed to reduce its fine for the Cabinet Office's honours data breach from £500k to £50k. That's a very significant reduction
UPDATE: In light of our new enforcement approach to the public sector, we have reached an agreement with the Cabinet Office on the fine issued for the New Year Honours data breach. Read more here: ico.org.uk/about-the-ico/med…

Not sure how to feel about this - on the one hand, the fine is paid into the Treasury, which could presumably hand it back to Cabinet Office, so it's unlikely to have any real impact. On the other, this isn't a great message to be sending about the importance of compliance
