It’s only when someone takes the time to pore through the publicly available case files that a very different picture begins to emerge.
One of the largest law firms stood 100% behind Juston’s case. That speaks volumes.
But what we learned is just how difficult it is to overcome qualified immunity, and how the legal standard of what a “reasonable” officer would do can shield deeply troubling conduct from accountability.
The courts accepted the police narrative without, in our view, meaningfully challenging it. And the 30-day investigation into Juston’s death raised more questions than answers.
Consider this:
The Boston officer who shot Juston five times was also the closest officer to him in Brookline, where another eight shots were purportedly fired. Casings were recovered the following day by Bukhenik and others.
That same officer gave an account of his body-worn camera that we believe the evidence contradicts, and tossed his BWC back in his cruiser.
What was there to hide? Why weren’t these contradictions thoroughly examined?
Almost 7 years later, our family is still fighting for the truth.
