After time off to settle into private practice, it felt great to do some opinion writing again. In my latest for @TheHubCanada, I explain why - for the good of our democracy - Liberal MPs must assume the power to expel their leader. #cdnpoli #ReformAct

If you want to read one book that will guide you through the arguments that will be made in the very near future about the proper roles of courts and legislatures, this is it! Get @Mark_S_Harding's "Judicializing Everything?" today --in paperback!
Very excited to see that my book, Judicializing Everything?, is now available in paperback! Especially gratifying to see such generous endorsements from colleagues whose work I greatly admire and respect.

Civility is back.
Congratulations to Jennifer Whiteside on being named Interim Leader of the BC NDP.
I sat across the floor from her for a long time and she is a serious person who works hard for the people she represents.
A good opposition makes for a better government, and I expect her to hold us to account while we get to work delivering what we promised British Columbians.

If you aren’t paying attention to B.C politics you should. Historic things are happening over there. The province has become the frontline for a lot of the issues Canadians are debating:
- An unprecedented miscalculation from NDP premier David Eby who called an election two years early over political opportunism- reaching to make a race about Trump. He wound up losing government, and his leadership.
- A repudiation of progressive policies on crime/substance abuse.
- An expression of unease towards how Indigenous land claims and property rights are being handled there.
- An incoming premier in Lorne Doerkson who has only been Con interim leader for 35 days, following an unexpected call while he was vacationing in Africa. Thrust into the role after Kerry-Lynne Findlay’s (the just elected Con party leader) epic flame out.
Following major celebrations, Conservatives should think long and hard about whether the “true blue” candidates they elect at convention are capable of winning general elections/the broader appeal of average voters. I think this was a case of the revenge of conservative normies.
It’s the province’s first Conservative government in nearly a century.

Last night British Columbia elected a majority Conservative government for the first time in a century. British Columbians wanted change, and voted for it in a big way.
Playing a part in this campaign as Director of Communications has been one of the coolest things i've ever done. An incredible team that had to be put together on the fly, and pulled off a truly remarkable accomplishment. I'm so proud of so many people.
The future looks bright for BC.

One way the PM could immediately address the proposed amendment dealing with judicial appointments is by promising only to appoint superior and intermediate appellate court judges who have been approved by premiers (as appears to be the case with the recent appointment of Malcolm Lavoie).
In other words, he could commit to establishing a new convention, which would make a formal constitutional amendment unnecessary.

The @CDNConstFound intervened in the bike lanes case at the Ontario Court of Appeal. Even though I personally like these bike lanes, there is no positive constitutional entitlement to them. We said so in the appeal. The Court decision is correct. Policy is for the legislature.
As a member of both organizations, I look forward to reading the open letters from @Advocates_Soc and @CBA_News to David Thompson about how editorials such as this dangerously undermine our democracy.

Why is it that so few contemporary Canadian architects have any interest in building according to distinctively Canadian vernacular styles?
There is a wonderful deposit of 19th and early / mid 20th vernacular Canadian architecture that, if replicated, could make our cities feel so much more like home.

A genuine victory and a worrying defeat all wrapped in one. A real, genuine, and good, stopping of a law that would have killed many who are particularly vulnerable. Ridding ourselves permanently of MAiD for mental illness is a genuine good and the minister should be congratulated on taking this stance. At the exact same time, introducing advanced directives, will expand MAiD and open up new doors for abuse that are genuinely harmful and heinous. Moreover, it wasn’t necessary to introduce this as part of the bill. Official @cardusca statement coming shortly.

My friend @CamdenHutchison and I argue in our forthcoming paper for UBC Law Review that freedom of peaceful assembly does not protect physically coercive assemblies such as blockades. Many court decisions support this view. Police need to enforce the law.

If you: 1. Block train tracks (as happened in Belleville) 2. Block downtown Ottawa streets (as happened with the convoy, and these elderly people) 3. Block streets with antisemitic hatred (as happens pretty much every week by Hamas supporters and their left wing supporters) 4. Or if you block streets without clearance from municipal authorities FOR ANY REASON... you should be quickly, firmly, and consistently arrested and removed from streets.
