Collating my work on trade security to pin this on Twitter. Check out the readings below! Thanks so much.
I suppose the question is whether US officials are nervous about all the Canadian press concerning forthcoming European talks.

Why has an Alberta referendum made it difficult for USTR to negotiate? Have US mid terms made it impossible for this administration to?

So 338 is meant to empower the POTUS to impose tariffs after finding evidence of specific disadvantages relative to treatment vis a vis foreign products…not based on exemptions raised by a Senator…unless we’re backtracking investigations?
338 depends on found factual evidence of discrimination of US commerce. But if the US liberalised trade in an FTA have to wonder how such disadvantages hold up. If you negotiated and agreed, that is. Historically, 338 was a tool to press for asymmetrical reciprocity with Canada.

So... the anti-coercion instrument?
When the American Society of International Law IEL group, led by Wolfgang Alschner, asked me to join a group to discuss blogging, my first thought was: Who would spend time on a session about this? Judging by the interest, at least a few people.
We have a number of good questions lined up for discussion. But let me say this. There are some very clear benefits and costs to devoting time to blogging. More than anything, it fuels the current discourse and adds immediate value to those practising the law.

I remain unclear how this trade tool would operate. ACI on steroids? Without the prevention? What of due process and accountability? What about harm to trusted partners? Persuade partners to align? Subject to international review? Cut off but also rebalance? Thresholds?

This weapon would allow Brussels to rapidly cut off market access when a trading partner causes severe economic distortions or engages in coercion
It would mark a dramatic shift in the EU's trade policy - now it's on the table.
I worry that EU leaders imagine there is some magic weapon hidden behind a secret door ready to be unlocked. But there is no easy answer to Europe's economic competitiveness. And the politics cannot get behind the right policies until that reality sinks in.
New: EU leaders to ‘urgently’ call for new trade weapons to tackle China shock
Leaders of EU’s 27 member states will instruct Brussels to “urgently” come up with new weapons to counter imbalances caused by China’s economic policies, at a summit tomorrow

A safeguard, as compliant with WTO rules, would only come after the appropriate investigation of impact on a domestic industry, not as a negotiated outcome.
So this is better understood as mutually settled trade management.
And by the way, there are WTO conditions for a selective safeguard, including a commitment to consider what is equitable to all suppliers, eg. UK, Japan, and Korea.
Yes. It resembles the US push for use of non-violation complaints and rebalancing of security measures. Bypass some of the formal stickiness of compliance to make a woolly compromise that suits present politics.

Reading between the lines:
All sounds very airy fairy in current climate, but optics of this deal surely a huge boon to China. Can show the world that it values WTO & system. Can negotiate a deal with a big power. So it's a PR win that soothes ties with major trade partner
