School suspensions and exclusions can be difficult for both children and parents. When a child is suspended or excluded from school, understanding the reasons behind the decision and knowing what options are available can make a real difference. In England, schools must follow specific procedures when suspending or permanently excluding a pupil. Parents also have rights when it comes to challenging certain decisions. These situations can become particularly complicated when allegations are still being investigated or where a child has additional educational needs. At Monan Gozzett LLP, our team advises families on school suspensions, exclusions, admissions and appeals, helping them understand their rights and the options available. #MonanGozzett #EducationLaw #SchoolExclusions #LegalAdvice

Do both people have to agree to a divorce? If one person wants a divorce and the other does not, it can be difficult to know where you stand. In England and Wales, you can make a sole divorce application without your spouseโ€™s agreement. They cannot challenge it simply because they want to remain married. Under the no-fault divorce system, you also do not need to prove that either person was to blame for the marriage breaking down. There are still legal requirements and formal steps to follow. Our Family Law team can explain your options and guide you through the process. Contact Monan Gozzett for clear, practical advice. #MonanGozzett #FamilyLaw #Divorce #NoFaultDivorce

Do grandparents have a legal right to see their grandchildren? When families separate, it isn't always just the parents and children who are affected. Grandparents can also find themselves struggling to maintain contact with their grandchildren. In England and Wales, grandparents do not automatically have a legal right to see their grandchildren. However, that doesn't mean there are no options available. Where arrangements cannot be agreed between family members, mediation may help. If an agreement still cannot be reached, grandparents may be able to apply for a Child Arrangements Order, although permission from the court is usually required first. The child's welfare will always be the court's main consideration when deciding contact arrangements. At Monan Gozzett LLP, our Family Law team understands how difficult these situations can be and can provide guidance on the options available. #FamilyLaw #GrandparentsRights #ChildArrangements #FamilySolicitors #MonanGozzett

Can you challenge a Will after someone has passed away? The short answer is yes, but there must be valid legal grounds for doing so. A Will can be challenged for several reasons, including concerns about the person's mental capacity when it was made, undue influence, or whether it was properly signed and witnessed. In some circumstances, certain family members or dependants may also be able to make a claim if they believe they have not received reasonable financial provision from the estate. However, simply being unhappy with what someone has left you isn't necessarily enough to challenge a Will. At Monan Gozzett LLP, our experienced team can advise on Will disputes, help you understand your legal position and explore the options available. If you have concerns about a Will, seeking legal advice early is important, as time limits may apply. #QuestionOfTheWeek #ContestingAWill #InheritanceDisputes #WillsAndProbate #MonanGozzett

๐——๐—ถ๐—ฑ ๐˜†๐—ผ๐˜‚ ๐—ธ๐—ป๐—ผ๐˜„? If you lose mental capacity without a Lasting Power of Attorney (LPA) in place, your family does not automatically have the right to make decisions on your behalf. In some circumstances, they may need to apply to the Court of Protection for authority to deal with matters such as your finances, property or other important decisions. This can involve additional time, cost and administration at an already difficult time. Putting an LPA in place allows you to choose people you trust to act on your behalf should you need support in the future. Planning ahead can provide reassurance for both you and those closest to you. If you would like advice about putting a Lasting Power of Attorney in place, our Private Client team is here to help. #MonanGozzett #LastingPowerOfAttorney #LPA #PrivateClient #CourtOfProtection #LegalAdvice

No. In England and Wales, attending voluntarily means you are not under arrest, but an interview as a suspect is still conducted under caution. What you say can be used as evidence. You have the right to legal advice before and during the interview, including access to free advice through the duty solicitor scheme. A solicitor can help you understand the allegation, explain your rights and advise you on how to respond to questions. Getting advice before the interview helps you make informed decisions from the outset. Asking for a solicitor does not mean you have done anything wrong. It is about understanding the process and protecting your rights. #CriminalLaw #PoliceInterview #KnowYourRights #MonanGozzett

Can messages be used as evidence in a legal case? Text messages, WhatsApp conversations, emails and social media messages can all be relevant evidence in legal proceedings. However, an individual message or screenshot may not always show the full picture. The wider conversation and context can be important when considering what a communication actually shows. If messages or other digital communications could be relevant to a legal matter, it is important to preserve them crather than deleting potentially useful evidence. Depending on the circumstances, digital communications can help provide important context and support the evidence in a case. #LegalAdvice #DigitalEvidence #LegalProceedings #MonanGozzett

What is a non-molestation order, and when might one be needed? A non-molestation order is a civil court order designed to protect an individual, and where relevant their children, from abuse, intimidation or threatening behaviour. This can include violence or threats of violence, abusive language, nuisance phone calls and other forms of harassment. Importantly, domestic abuse isn't always physical. Non-molestation orders can offer protection in circumstances involving emotional, psychological, financial or sexual abuse, as well as coercive control. Breaching a non-molestation order is a criminal offence, so these orders should always be taken seriously. Every situation is different, but understanding the legal protections available can be an important first step for anyone concerned about their safety or wellbeing. #FamilyLaw #NonMolestationOrder #FamilySolicitors #LegalAdvice #MonanGozzett
