Middle District of Florida Judge Timothy Corrigan, appointed by President Bush, will assume senior status in November 2024. This creates a fourth vacancy on the court, which currently has one nominee pending.

There’s now only one circuit judge vacancy without a nominee. If you’re a circuit judge and you want Biden and a Dem Senate to confirm your successor, retire NOW. Several judges did so at the end of 2021, giving the WH and Senate enough time to find and confirm replacements.

If confirmed, Berner will also be the third-ever openly lesbian judge on any U.S. appeals court. She'd be the first on the U.S. Court of Appeals for the Fourth Circuit.
