Everyone who tweets like this should be made to set out the specific points they find “repugnant,” with reasons. The institutional critiques he makes were all being made in the 1940s & 50s, including in the literal Constituent Assembly. Your historical amnesia is not his fault.
The issue is neither your pen name nor your right to challenge Sharjeel Imam’s views. I agree that his statements in that interview are deeply anti constitutional, anti secular and highly illiberal.
But the central issue is different- Do repugnant views justify prolonged incarceration and a delayed trial?
Anti constitution and anti secular views are espoused by countless people cutting across the political spectrum. Yet the Constitution guarantees fundamental rights even to those who reject its values. That is precisely the strength of our constitutional democracy.
You are perfectly entitled to challenge Sharjeel’s ideology and much of it deserves to be criticised. But ideological disagreement cannot become a justification for indefinite incarceration. Unlawful acts should be prosecuted but due process and personal liberty cannot be made conditional on the acceptability of someone’s political beliefs.
The real test of constitutionalism is defending the rights of those whose views we find most objectionable. Otherwise our commitment is not to the Constitution but merely to our own ideological preferences.

Over dozens of students onboard Goa Express and on their way to participate in protests in Delhi were detained by the local police in Itarsi, Madhya Pradesh.

So if you’re wondering why protesting needs permission, it’s because we have an executive-centric constitution that has been interpreted by a historically executive-centred court, to uphold colonial executive-centric laws as constitutionally compliant.

During the framing of the Const, Somnath Lahiri explicitly said that the fundamental rights chapter was written from the perspective of a police constable. In the 1980s, KG Kannabiran was writing that the Sup Ct treats the restrictions as “fundamental” instead of the rights.

One important thing to understand is that the legal architecture around the right to protest in India remains colonial in its design, and the Supreme Court has been enforcing this colonial architecture since 1960. The Constitution did nothing to change this.

I bought a Yoga Bar Protein Bar for my mother. She ate some of it before we found worms inside.
The product was not expired, and my mother is a pure vegetarian. This is so disturbing.
