He has helped hundreds of Nigerian Law School students succeed. For free. Meet Yusuf Asamu Olalere (Lere) @Lere_Esq, founder of NLS Trailblazer Mentorship. According to the programme, it has supported over 400 students across six cohorts, including students who went on to achieve First Class results and win prizes at the Nigerian Law School. What makes his story special? He's doing this alongside his legal career, with a team of volunteer mentors, some of whom were once mentees themselves. This week's YoungVIP Spotlight celebrates Lere and everyone giving their time to help others succeed. This is the kind of giving back we love to see. 👏🏽❤️

Law School students, how do you know whether to draft 2, 4, or 10 counts in a Criminal Litigation question? 🤔 One mistake to avoid is counting defendants, victims, or incidents without first identifying the offences disclosed by the facts. Here are some practical tips for determining the number of counts in your Bar Finals. 🧵

4. Watch out for exceptions. Not every transaction requires a separate trial. Under section 209 ACJA, joinder may be permitted for: • Three offences committed within 12 months. • Any number of offences of the same type. • Offences committed in the same transaction. Section 214 permits alternative charging in appropriate cases. Section 197 also permits a special aggregate charge for criminal breach of trust or fraudulent appropriation of property.

5. Before drafting your charge, check: Which court has jurisdiction? What offences do the facts disclose? Which defendant is linked to each offence? Can the offences and defendants be joined? What statutory provisions and particulars must be included? Under sections 194 and 196 ACJA, pay attention to the offence, applicable law, time, place and relevant particulars. The goal is to draft counts supported by the facts and the law. Save this for your Bar Finals revision.

Law students, did you get Day 15 of our Bar Finals Challenge right? 🤔 DAY 15 ANSWER: D ✅ The sale to Mr. Okonkwo is valid despite Meridian Bank’s premature exercise of its power of sale. Mrs. Adebayo may, however, sue the bank for damages. Here’s the legal breakdown. 🧵
Law School students, can a bank sell a mortgaged property before its power of sale becomes exercisable and still pass a valid title to the purchaser? 🤔 DAY 15/15: YoungVIP Bar Finals Challenge PROPERTY LAW PRACTICE Mrs. Adebayo owns a residential property in Ibadan, Oyo State. She obtained a loan from Meridian Bank Plc and created a legal mortgage over the property by deed. The mortgage money became due on 1 September 2026, but Mrs. Adebayo failed to repay it. The mortgage deed contains no provision excluding or varying the statutory power of sale or the conditions governing its exercise. On 3 September 2026, Meridian Bank served her with a written notice demanding repayment of the principal sum. Six weeks later, the bank sold the property to Mr. Okonkwo, who purchased it for value, in good faith, and without notice of any irregularity. The sale was completed by a deed of conveyance. At the time of the sale, no mortgage interest had been in arrears for two months, and there had been no breach of any other covenant in the mortgage deed. Mrs. Adebayo challenges the sale, arguing that the bank had no right to sell the property before the expiration of three months. Which statement most accurately represents the legal position? A. The sale is invalid because a mortgagee cannot pass a valid title until its power of sale has become exercisable. B. The sale is valid because the mortgage money had become due, making the mortgagee's statutory power of sale immediately exercisable. C. The sale is invalid because Meridian Bank failed to obtain a court order authorising the sale, notwithstanding Mrs. Adebayo's default. D. The sale is valid against the innocent purchaser because the bank's power of sale had arisen, although it was not yet exercisable. Mrs. Adebayo may, however, sue Meridian Bank for damages. Drop your answer below. If you want, tell us why you chose it! 😊

THE EXCEPTION But what happens if the bank sells prematurely? Under section 126(2) PCL, a purchaser’s title is protected against specified irregularities in the mortgagee’s exercise of its power of sale, including premature exercise or failure to give proper notice. The injured mortgagor’s remedy is damages against the mortgagee. See Olaleye v. Wema Bank Ltd (2010).

APPLICATION AND CONCLUSION Meridian Bank sold the property six weeks after serving notice. None of the conditions under section 125 PCL had been satisfied. However, Mr. Okonkwo purchased in good faith, for value, without notice of the irregularity, and received a deed of conveyance. Therefore, his title is protected under section 126(2) PCL. Mrs. Adebayo may sue Meridian Bank for damages.
