But AFL is representing fifteen local viewers who say the FCC should review and deny the license renewals altogether due to ABC’s discriminatory, race-based employment practices.

The Supreme Court made clear in Students for Fair Admissions v. Harvard that universities cannot evade the prohibition on racial discrimination by disguising unlawful preferences through application essays or other means.
Medical schools cannot use race as a shortcut around merit.
Changing the terminology does not change the law.
