Two potential flaws here: First, His manner of entry with a B1/B2 is a Visitor Visa. If he knew he was going to marry Annie, he entered with the wrong Visa and misrepresented his actual intent: to marry, which would require a Fiancée Visa, and invalidate the “legal entry” which was obtained through potential fraud. Second, if he filed the I-485 under Biden, he had to take the Covid shot. Reportedly, he refused to take it. The case may have been filed and denied and he never filed an I-485 again under Trump. Hence the DHS statement, no pending applications. Since nothing was pending, he is removable as an overstay. The family seems very confused and someone dropped the ball, but it wasn’t DHS.
