Sealing offshore tax leakage without restoring domestic competitiveness simply relocates trading volume rather than solving the problem. To fix the current framework, enforcement architecture and tax design must move together through a two-pronged strategy: closing structural loopholes while recalibrating punitive tax rates to bring investors back to compliant domestic exchanges.
Key reform measures include closing the P2P loophole under Section 393, requiring offshore platforms targeting Indian users to register domestically via amendment in Corporate Amendment Bill 2026, reducing the TDS rate to 0.01%, and allowing loss set-offs. The revenue logic is clear: a lower tax rate applied to a substantially larger, compliant base will generate far more sustainable exchequer revenue than a high tax rate on a rapidly shrinking domestic market.

The US Securities and Exchange Commission (SEC) has updated its FAQs on the application of federal securities laws to certain crypto assets and crypto-related transactions. The FAQs provide staff guidance on the SEC’s March 2026 interpretive release, including the classification of crypto assets and the application of investment contract principles.
The updated guidance also addresses token buyback programmes, stating that where a crypto system is functional, an issuer’s announcement of a non-security crypto asset buyback would not constitute a representation or promise to undertake essential managerial efforts. The SEC states that the FAQs are non-binding and do not create new legal obligations.
