Former SC judge Sanjay Kishan Kaul’s memoir reveals a quiet rift with then CJI DY Chandrachud: he was “too deferential” to the Govt on appointments, sought its “nod” before Collegium meetings, and once raised a “bizarre” caste query about a minority-faith candidate—prompting Kaul to walk out. Kaul’s core point: the government respects judges with a spine. Collegium isn’t insulated from political pressure; the real test is holding institutional integrity while navigating it. Chandrachud says he doesn’t recall the walkout and that meetings involved reasoned dialogue. The insider account lands at a time of heightened scrutiny of the SC–executive relationship. Reminder - Article 19 Indian Constitution guarnatees freeom of assembly and peaceful protest. The fundamental issue today before the Republic and constitutional courts is the (mis)use of laws and pretext of law and order to stamp out our freedoms. Police Orders under Sec. 163 BNSS are de facto extinguishing constitutional freedoms of free speech, assembly and right to peaceful protest by citizens. Whenever, wherever citizens gather to peacefully protest against the SIR and the Chief Election Commissioner, the Delhi Police, operating under the Home Ministry, promptly issues prohibitory orders under Sec 163 BNSS (144 CrPC). Then announcements are made that the protest is illegal, detentions, police excesses and preventive arrests follow. The Police Orders and actions have to meet the test of reasonableness, legality, validity, and proportionality. Protests, speeches, slogans against SIR and Gyanesh Kumar and BJP -NDA Govt is Not breach of peace. Abuse of power = Constituional Disorder
