"FCC rules on news distortion or hoaxes do not apply to a station that reports this data in good faith." -@AGomezFCC
During this election season, there has been a significant surge in entirely Fake Polls and Suppression Polls designed to do nothing more than interfere with the regular functioning of the electoral process and alter the normal patterns of voter turnout and enthusiasm. Many journalists and broadcasters have been amplifying or airing these Polls without regard to basic journalistic ethics and without informing the public that those Polls lack a scientific, accurate, or even real basis. The FCC takes these issues seriously. Broadcasters are prohibited by the terms of their federal licenses from engaging in News Distortion or promoting Broadcast Hoaxes. It is important that broadcasters comply with their public interest obligations. After all, the country benefits greatly when Americans can trust and rely on the media to report the news fairly and accurately. Broadcasters are advised to avoid engaging in News Distortions or running Broadcast Hoaxes by airing Polls that would violate their regulatory obligations. If broadcasters believe they should provide their viewers with additional context and information about Polls they have covered, they can now take those actions consistent with FCC regulations.

Yet another weaponization and abuse of the @FCC’s news distortion rule. This agency and its Chair are completely off the rails and the chilling effect is real. @protctdemocracy

Bloomberg: FTC investigating YouTube's content moderation as deceptive, may soon sue. In 2020, the Republican FTC rightly refused Trump's demands to bring such suits because they would embroil the FTC in second-guessing editorial judgments in violation of the First Amendment 🧵

Today Senate Commerce marks up several Bad Internet Bills, including KOSA - which for years experts have warned violates the First Amendment. Instead of fixing the problems, KOSA's sponsors have denied they exist & tried to disguise them with obfuscatory language. My statement:

Protecting free speech and defending the First Amendment is not a partisan issue. There is clear bipartisan concern with how the FCC's targeting of ABC's local stations threatens the First Amendment rights of every broadcaster in this country.

Just out from me: The @FCC is close to releasing a pair of rulings against @Disney, determining The View is doesn't qualify as a news show and sending its TV licenses to an internal FCC review. This could happen as soon as next month.
