Justice Mubiru Orders woman who borrowed UGX 20 Million from @dfcugroup to pay UGX 165.7 Million plus Interest after presenting an imposter as her Husband and using her husband’s land title as security✍Under the strict doctrine of absolute contracts, once a party binds themselves to an absolute obligation, business losses do not discharge clear a commercial debt. ✍An acquittal in criminal case does not preclude a finding of fraud in civil proceedings, the wife knowingly presented a person she knew was not her husband as her husband, with the intent of inducing the bank ✍They were criminally prosecuted but acquitted, however, an acquittal in a criminal case, which requires proof beyond reasonable doubt, does not preclude a finding of fraud in civil proceedings, which requires only a standard higher than a balance of probabilities but lower than beyond reasonable doubt. ✍The evidentiary burden in the civil case is different and less onerous. ✍The plaintiff knowingly presented a person she knew was not her husband as her husband, with the intent of inducing the bank to extend an overdraft facility secured by land registered in her husband’s name, an act that falls squarely within the statutory and common law definitions of fraud. ✍Under the strict doctrine of absolute contracts, once a party binds themselves to an absolute obligation, subsequent supervening hardships, economic downturns, or business losses do not discharge or frustrate a clear commercial debt. ✍Frustration of commercial contracts applies only where performance becomes objectively or legally impossible, not simply harder or less profitable. Under section 66(1) of the Contracts Act, a contract is only discharged by frustration when an unforeseen external event makes performance objectively or legally impossible, or radically alters the obligation from what was contemplated. ✍The destruction of business assets is a commercial risk borne exclusively by the entrepreneur ✍ It is an elementary principle of the law of contract that a party who receives a financial facility under a valid agreement is under a strict legal obligation to repay the same. ✍The recoverability of a contractual sum as a debt hinges on its objective calculability. A formula or mechanism embedded in the agreement satisfies the objective test only if it yields a precise figure without discretionary or future third-party evaluation. ✍In claims for the recovery of a contractual sum, the general “touchstone” of a liquidated claim is whether the amount owed is capable of objective arithmetical calculation even if that may entail some measure of investigation. After my dad passed,I made a camp for this EP. In that camp I made Yoyo,Home and Commando. Commando was the first song I did after that crazy period in my life…I was taking crying breaks between takes.😂…And I was far from back to who I was. But I believe I’m destined for something greater than the pain I’ve been through so I keep going. Life of a commando.♥️

In Jordan Sebuliba Kiwanuka vs. Mohan Musisi Kiwanuka; Civil Appeal No.61 of 2020 (May 30, 2025) Court of Appeal (per Cheborion, Gashirabake & Mugenyi, JJA) reaffirmed the purpose of a proper and complete record of court proceedings as an integral part of judicial accountability.
88 out of 88, I discuss in my Article on the STANDARD TODAY how Judicial officers play a Role in deliberately distorting the Record of proceedings that eventually affect the Appellate processes. ✅ Take a Read. I also implore upon the Judiciary to get more serious with the issue of Records of the Court, especially typed proceedings at the Magistracy

STOP POISONING US WITH FATUOUS JUDGMENTS! Do judicial officers today remember that a judgment does not end in their courtroom? It finds us in the classrooms. I read an election petition judgment this afternoon. With respect, I have vowed never to read any judgment from that judicial officer again. It was not just wrong. It was worrying. A judgment is supposed to teach. At Law School, we are told to read judgments to appreciate principles. How do you appreciate a principle from a judgment that infringes all Principles governing judgements , application of the law and evaluation of evidence ? The law is settled. A judicial officer must give reasons. Not just any reasons to cover up but good reasons. Its beyond closing files and having a lot of returns , Justice should be served hot and must be seen to be done through reasoned decisions. A judgment is a legal document for the public, for law students, lawyers and for other courts. It is said - “Ratio decidendi est anima judicii.” The valid reason for the decision is the soul of the judgment. If the soul is missing, what is left? These days, it is hard to be a law student. You open a judgment expecting to learn. Instead, you find contradictions, confusion, and law that does not relate to the issue at hand. Do these people even ever appeal? I need to find the statistics to the number of cases that go for appeal! At Law school, we frequently used to laugh at some decisions and wonder what is wrong with some judicial officers. Then you get angry because this is the law that will govern us. A fatuous judgment is not a small mistake. It poisons the system. A law student reads it and gets confused. An advocate cites it and misleads his client. A lower court follows it and causes an injustice. A judicial officer holds a pen that shapes the country legal and social conduct. That pen should not be used carelessly. If you cannot write a judgment that can be read by a law student, by a magistrate, and by the Supreme Court without shame, then please, do better. Or do not write at all. Recuse yourself! We deserve better judgments. The law deserves better. I am not condemning the bench but calling it back to the people! @JudiciaryUG @ODPPUGANDA @ug_lawsociety

The Elwelu issue has stirred a lot of talk across Teso. Admittedly, many sympathise with him. Ecweru's ultimatums and threats have not helped, and if anything, have only increased public sympathy for Elwelu. As Teso leaders, lets front dialogue, and avoid strong man posturing.

🚨 Justice cannot be served fairly when a party is ambushed by the clock. The Court of Appeal has reset a hearing because the notice given was too short for a party to prepare. This is Castillo & another v Nkingis Kisemei & others, Civil Application No. NAK E039 of 2021. Here is what it means. The issue was not the merits of the dispute. It was timing. A hearing had proceeded on notice that the Court of Appeal found inadequate, too little time for the parties to get ready. The Court did not paper over it. It directed that all parties be served afresh and a new hearing date be fixed. The principle behind that order is one of the oldest in law. A fair hearing is not only the chance to be present. It is the chance to be ready. Under Article 50 of the Constitution, every person has the right to have a dispute decided in a fair hearing, and Article 25 places that right beyond limitation. The right means little if a party learns of the hearing so late that they cannot gather their evidence, instruct an advocate and put their case properly. Adequate notice is what turns the right to be heard into a real one. Short notice, then, is not a technicality. A decision reached after a party has been denied time to prepare is open to challenge, and will often be set aside, exactly as happened here. The cure was not to punish anyone, but to restart the step properly, with proper service and a fresh date. The legal dispute worth noting. On one side, courts are under real pressure to move cases along. Backlogs are heavy, delay harms everyone, and firm hearing dates are one of the few tools that stop litigants from dragging a matter out, so there is a strong pull toward holding the date and getting on with it. On the other side, speed is not the same as justice, and a hearing that a party could not properly prepare for is not a fair one, however efficiently it was conducted. An ambush by the clock tends to produce a result that has to be undone later, which serves no one. Where the drive to dispose of cases quickly ends and the right to adequate notice begins is the line this ruling draws. Key takeaway: a fair hearing requires adequate notice, enough time to prepare, instruct counsel and take part meaningfully. Where the notice falls short, the hearing can be set aside and the parties served afresh. Being heard means being given the time to be ready. 👉 Follow @Lexken_EMSLaw for practical legal insights on civil procedure and the right to a fair hearing.
