We have filed, on behalf of our Palestinian client, a demand for warrants for the leadership of Hamas at the @IntlCrimCourt for the crimes committed by the terrorist government of Gaza against the Palestinian people. @KarimKhanQC and the Office of the Prosecutor cannot say that they truly care about justice if they continue to ignore the blatant crimes committed against the Palestinian people by Hamas. These crimes include numerous crimes against humanity and war crimes committed by Hamas against the Palestinian people. Notably including the war crime of utilizing the presence of civilians or other protected persons as human shields. There has never been a demonstration that the Palestinian's are willing and able to investigate Hamas for these crimes. Hamas' purposeful conduct in Gaza has greatly exacerbated the harm against Palestinian civilians. The unnecessary suffering of the Palestinian people must be accounted for and the ICC cannot claim to care about justice if it remains silent on these crimes. Thankful to the work of my colleagues, Eli Rosenbaum, and @sarah_scialom, and our brave client who came forward to tell their story.
Exclusive: A Gazan man's lawyers made a submission to the International Criminal Court (ICC) prosecutor demanding that 14 Hamas leaders be investigated for crimes committed against the Palestinian people, marking the first such filing by a Palestinian against Hamas. ✍️ @MathildaHeller jpost.com/middle-east/articl…

Is Japan as such racist? Coates says there is no β€œmajoritarian ethnographic [sic] project that is not racist.” Again, taken to its logical conclusion, this would render many existing states β€œracist.” Which is absurd.
We hosted a landmark conversation between Ta-Nehisi Coates, Tareq Baconi and Nesrine Malik at London's Southbank Centre this week. You can watch the whole event here: youtube.com/watch?v=652EVCK1…

If anyone wants a fun story of data nerds data nerding, @ErikJimenezNV and I were with @ZConine in 2022 when we were the first to call NV-3 for @SusieLeeNV and Zach called her to tell her the news. She naturally pushed back on us but we knew if she won the E-Day vote, it was game over. She won it big. Good times. Also, Erik’s data has been fantastic and super interesting to read every day. You should follow along.
I am very appreciative of Jon for uplifting my data analysis project (one I do for free on nights/weekends purely for the love of the game). If you enjoy what I’m doing now, then stay tuned for the 2028 data portal to come.

Actually, it doesn’t take a conspiracy theorist to sound the alarm bell of possible politicization and weaponization of the court. Because they must be β€œimpartial” does not mean that they are in practice, either. That’s a red herring to distract from obvious issues of the ICJ.
The Gambia v. Myanmar case will be decided by 16 ICJ judges (15 elected ones - 1 as Judge Okowa has recused herself due to her past involvement in the case +2 ad hoc judges). A judgment - which cannot modify the definition of genocide but can only interpret and apply it, following the rules of treaty interpretation - will have to be supported by at least 8 of them (in which case including casting vote of the President). Moreover, as you are undoubtedly also aware, ICJ judges must fulfill the criteria of being independent, "persons of high moral character", with necessary legal qualifications, and "of recognized competence in international law" (Art. 2 ICJ Statute). It thus takes quite a conspiracy theorist to argue, as you do, that Judge "Pillay and her supporters are poised to hijack the Myanmar case to drastically reinterpret the genocide standard so as to retroactively justify her claim that Israel committed genocide" and think that, in that conspiracy scenario, they could so succeed. To suggest that at least 8 (including the President) or 9 ICJ judges or would adopt a judgment based on ulterior motives is just wild. Any of the judges who share Judge Pillay's - a renowned and respected expert - position(s) regarding the interpretation of the Convention's defintion and its application, whichever specific positions those may be, must have adopted those based on substantive legal considerations.

So she β€œunlearned” propaganda by surrounding herself with propaganda?
Hannah Einbinder, the multimillionaire socialist actress, turned anti-Israel mouthpiece, said in an interview that she was able to unlearn the "propaganda" she'd been fed in the Jewish community by surrounding herself by anti-Zionists. So, by surrounding herself only with people of the exact same opinion she was able to escape the echo chamber of the Jews. ...Do I have to spell out the problem here?

I've now catalogued 5,300 confirmed Gaza combatants killed by name, mostly from Hamas & PIJ's own martyr notices, and closing in on 6,000. Analysis & results in process. The evidence documents systematic military use of hospitals, schools, etc. and other human shield practices.

Alonso's whole schtick is systematically ignoring the actual words people use and replacing them with materially different ones that better fit his predetermined narrative. Here, for example, this weasel tries to pretend that "the killing of children" in war - the phrasing Sidoti actually used as purported "evidence of genocidal purpose" - is somehow the same thing as "targeting children". As if the distinction between the two weren't precisely "the difference that makes all the difference".
ffs… he *is* applying the only reasonable inference test… this is what Britain, France, Denmark, Germany, Canada and the Netherlands said on targeting children and ORI intent. This is why they are terrified of the Myanmar case. They already said this… can’t take it back

I agree! I wish that Gambia’s legal team did a better job with all of the evidence.
Huh. Well, I’m really interested bc I want justice and accountability for the Rohingya people. Crazy I know.

It quite literally does not.
If this is the standard that justifies treating Rakhine as genocide, then Gaza is a genocide too. Everything you’ve listed has a comparable policy in Gaza

This is confusing separate issues. One is the intentional targeting of children. The other is when children are killed in an armed conflict. Those aren’t the same thing. The argument being advanced by Britain, France, Denmark, Canada, and the Netherlands going back to the issue of genocidal intent and nothing else. If we say that children have been killed in a war is equal to evidence of genocidal intent without demonstrating the purposeful and willful targeting of them as children of the group, that’s not indicative of what genocide is. I really wish that @martinshawx would stop portraying himself as an expert on the law when he isn’t and he’s regurgitating something incorrect.
In the Myanmar genocide case currently before the ICJ, Britain, France, Denmark, Germany, Canada and the Netherlands said that targeting children was indicative of genocidal intent. None of them have commented on Israel’s targeting of children, on which the UN commission reported. But the issue will come back to bite them.
