A man got 80 years for killing the predator who molested his child, allegedly for months. And what about the child predator? Well, he was sentenced to 12 years but only spent about 7 years behind bars. Nicholas Stanley, 36, of Elkhart, IN, was sentenced Thursday to the max of 80 years for killing a convicted child predator. Sounds more like did the community a favor, to me. In 2018 Cogswell pleaded guilty to molesting Stanley's child, who was under 14, and to possessing child pornography. 3 more counts were dropped in the plea deal. Why in the world would any prosecutor agree to this? Stanley says the abuse went on for 8 months. Cogswell got out on probation on May 28, 2025. Months earlier, a judge had denied him early release because of conduct violations in prison. Cogswell moved into the Daylite Inn. Less than a month later, shortly before 1 a.m. on June 24, 2025, Stanley went to room 251. He testified that he planned to confront Cogswell and beat him up. He said seeing Cogswell through the window made his brain "explode like a tsunami." He got a shotgun from his car, knocked, and shot Cogswell 2x in the head and chest when the door opened. He told the jury, "I decided that I had to do what I had to do to protect my family. I had to kill him." He was found guilty of murder last month. The sentence is 65 years for murder plus 15 for the firearm enhancement, and he must serve at least 75%. His attorney is appealing because the judge refused to let the jury consider a sudden heat defense, which could have meant a manslaughter conviction. I think the judge should consider the "taking out the trash" defense. Supporters rallied outside the courthouse last year demanding harsher sentences for sex offenders.
