On Monday, October 26, 2026, Judge Jacqueline Henriques ordered that the proceeds be held in an interest-bearing trust account by a curator bonis pending further legal action by SARS. The ruling follows a preservation order granted on November 21, 2024, under the Tax Administration Act. SARS reported that, as of September 19, 2025, Mkhize owed R13.3 million in personal income tax and was personally liable for R112.5 million in tax debt linked to the Zikhulise Group, including interest. The five properties have a combined municipal valuation of R22.83 million, an estimated market value of R35 million and a forced-sale value of R24.5 million. Municipal arrears for four properties totalled R1.8 million as of October 3, 2025, while monthly security costs across the properties amounted to R188,000, paid by SARS. The court said maintenance expenses and mounting costs were eroding the properties' value. Judge Henriques also gave SARS one month from the date of the order to institute legal proceedings seeking to have the properties or their sale proceeds declared executable against the outstanding tax debts. The judge noted that the opposing parties had not disputed SARS's factual allegations and dismissed their preliminary legal objections, ruling that SARS was entitled to the orders sought.
