The significance of yesterday’s Supreme Court is about a massive police reform. A poor man is picked up from his house on on suspicion and on pretext of questioning.
For hours he may be tortured in police station without water before he is formally arrested.
Once an arrest is formally registered in register, the law takes over and within 24 hours he is to be produced before Magistrate.
But the hours and hours he spent at police station before finally arrested goes unrecorded.
These are dark hours. Even his relatives or lawyers may have no access to him. During these hours often custodial deaths are reported and it is found that CC TV camera in police station were not working at that time.
The new judgement of Supreme Court changes everything.
The moment a poor man is picked up from his house, the cycle of 24 hours begins and the police has to produce him in one piece, in unharmed condition before Magistrate, who then can orders medical examination if he suspects that the poor man is tortured in police station.
This is a massive police reform. This is a Diwali Gift from Supreme Court to citizens.
