DEF submitted a response to the EU’s MiCA Review.
In it, DEF asks EU regulators to ensure three key protections:
👉 Protect developers. People who write and publish software should not be subject to regulatory obligations or inherit liability for how third parties use their software, or be classified under regimes that do not describe the activities they actually perform.
👉 Protect user autonomy. Self-custody and privacy-enhancing technology should be clear, affirmative, enforceable rights, not features that cost users their protections.
👉 Protect permissionless infrastructure. Definitions should be accurate and technology-neutral, and should preserve the line between non-custodial software and the intermediaries that control customer assets.
MiCA has a head start in clarifying the line between control and code, and we encourage the Commission to ensure these same standards apply as they build their report and consider any future amendments to MiCA.

"We recommend, as its next steps in advancing Project Crypto, that the SEC clarify the circumstances in which developers of decentralized exchange protocols (DEXs) and the apps that provide access to them (DEX Apps) fall outside the Exchange Act’s exchange registration requirements. That is why we, together with the DeFi Education Fund, are now proposing a safe harbor from exchange registration requirements of the Exchange Act." 👏

The @SECgov issued the long-anticipated “Innovation Exemption” today, to address onchain trading of tokenized securities and “Tokenized Securities Venues” (TSVs). This is a very important first step in bringing much-needed clarity to crypto market participants and users.
The order provides conditional exemptive relief from the Securities Exchange Act of 1934 definitions of “exchange” and “dealer” for certain trading platforms and liquidity providers that facilitate the trading of tokenized securities. While the order anticipates trading via permissioned automated market markers and liquidity pools, smart contracts used by a TSV must be auditable, public, and deployed on a public, permissionless distributed ledger. The relief is time-limited and subject to certain conditions, but this is undeniably a big step forward for those building on public blockchain networks.
We applaud the SEC staff and Chairman @SeCPaulSAtkins for working proactively to enable responsible innovation in America. The DEF team looks forward to continuing engagement with SEC staff and providing comments to the innovation exemption to assist the SEC in moving to proposed rulemaking. As always, DEF will work to ensure that DeFi technology is accurately described and that developers are sufficiently protected under securities laws.

🇦🇺 The Australian DeFi Community event on Saturday night was a huge success
🎫 We sold out our final ticket, 1 hour before the event, and everyone wanted MORE time to connect and get to know each other
💗I measure the success on how comfortable people are, how much they engage, and how far they'll travel - with some travelling interstate just to attend
🌟 This is only the beginning :)
🧚♀️ People are extremely optimistic about @i_am_blunt_ and croftr and the direction of DeFi and the energy has continued since the event

Crypto is full of surprises.
After Mt. Gox, Ethereum and the ICO era came along and reshaped the space. Then came DeFi and NFTs in 2020–2021, followed by the memecoin craze, launchpads, and countless new narratives.
Every time we think crypto is dead, or altcoins are dead, they come back stronger than before.
This time will be no different.
I’m betting on those who are ready to embrace change, adapt, and reshape the game.
The game is always changing. The winners change with it. 🚀

⚖️ One of the biggest $PDAI take aways from my interview with a Washington D.C. crypto lawyer was on issuance
❓ We wanted to know what the Clarity Act does with a token that has NO issuer – no company, no foundation, no one (
Amanda Tuminelli, chief legal officer of the DeFi Education Fund: "The bill presupposes that there is an issuer... I think that is a legal gray area"
The Clarity Act sorts every token into 3 lanes:
1️⃣ *Security* – an issuer sells it promising their efforts will make you money
2️⃣ *Restricted digital asset* – an issuer exists and owes ongoing disclosures
3️⃣ *Digital commodity* – no claims against any issuer, living on a decentralized chain
Two of the three lanes are DEFINED by presupposing an issuer. Lane 3 exists without one – and it's about your CHAIN passing the bill's decentralization test
Needs to be open source, transparent pre-set rules, and no person or group in control – including holding 20%+ of supply (HOWEVER, a nuance to that is whether that supply is issued over time or stays centrally located)
So for every forked or ownerless token, it still seems gray, and something we need to be mindful of as a community
🧐 Which chains actually pass a no-one-in-control test?
