Dr Edina Harbinja’s research at the European Law Institute is the most important work happening in digital inheritance right now and almost nobody in crypto is paying attention. The core finding: people don’t want inheritance law applied to their digital lives. They want chosen custodians. Specific people. Specific access. Specific conditions. That’s not how succession law works today. England and Wales recognised digital assets as property in December 2025. Big step. But recognition ≠ transfer. Knowing something is yours doesn’t tell anyone how to access it when you’re gone. The ELI model rules land later this year.
