In fairness, according to the New York Times article, there are some allegations here which are likely true. The source is the former chairman of Peltola's campaign.
The same source, though, says Peltola wasn't involved.
Even if the charges ARE true, they aren't necessarily ILLEGAL. They are looking into whether some campaign finance laws violated, but that has not yet been established.
Furthermore, when it comes to this sort of legislation, the REMEDY is the important part. If crimes were committed, then they should be prosecuted.
The court's first priority here is to protect the citizens right to vote.
Removing her from the ballot is punishing the citizens who would want to vote for her. That's not the proper remedy.
This is not the first time something like this has been done. It's actually fairly common. In 2020 the Senate 37th in Florida had the same thing happen.
The winner won by 32 votes. The like-name got 6,382 votes.
She is currently running for reelection. Her seat wasn't removed, and there were actual crimes involved here.
So why don't we make this illegal? Because how do you do that? Make it illegal to run under your own name if someone else has the same name?
Furthermore, in the grand scheme of things, so what?

A federal grand jury refused to indict.
Do you have any idea just how unusual that is?
Prosecutors only need to establish probable cause to get an indictment. It's a very low bar.
And they couldn't even clear it.
Another attempt to prosecute someone who dared cross Dear Leader, and another setback for his DOJ.

Cledith “Bud” Arthur was charged with incest involving his own 16-year-old daughter in January 1974. A grand jury indicted him in March. The sheriff couldn’t find him. That was all public record when Donna Stearns married him in December 1975 and brought 9-year-old Amy into the house.
