Any suggestion the Supreme Ct didn't expect Gnanasara Thero to be required to serve his prison term after his presidential pardon was held null and void but expected that a fresh pardon be given, is inconsistent with what's stated in the actual judgment in SC FR 256/2019 ⬇️ [1/3]
“Who are you trying to please by removing Ven. Gnanasara Thera’s robes and dressing him in civilian clothes?” Sarvajana Balaya leader Dilith Jayaweera said in Parliament, commenting on Galagoda Aththe Gnanasara Thera being produced in court in civilian clothes today.

The j'ment in SC FR 256/2019: (a) Doesn't find and/or hold and/or consider that Gnanasara Thero is deserving of a presidential pardon; (b) Holds the one given "null and void" - effectively, that he must be treated as never having got it, and so has to serve his jail term; [2/3]

(c) Simply clarifies that the judgment doesn't operate to cancel "pardonability" of Gnanasara Thero by the President, who may only exercise his power of pardon in accordance with the law and in due consideration of all relevant material placed before him. [3/3]

Why a judge mustn't be allowed to accept summons to explain a judicial action to police: • Any questioning of "correctness" of a lower court decision must be by recourse to a higher court. • Any alleged "judicial impropriety" issue should be flagged to the JSC for action ⬇️
