Replying to @SarahHuckabee
@SarahHuckabee and Arkansas state legislators support fair prices, local access and better care at the pharmacy counter by holding trillion dollar PBM middlemen accountable to state law ! @SenTomCotton @JohnBoozman @RepFrenchHill Let’s get this reform in DC !
PBMs drive up healthcare costs and abuse the law.
My administration already imposed a $1.5 million fine on these rule-breakers. I'm glad the Arkansas legislature took strong action to crack down on their malpractice.

Credit where credit is due: @USDOL PBM rules could be one of the most consequential policies to improve drug affordability for American employers in decades. Truly transformative stuff @Sonderling47 @DrOzCMS

NEW Exclusive: A new, final rule from the Dept. of Labor means that employers will get way more info on how their drug benefit managers are getting paid💰 -- including fees they get from drugmakers. Critics have long called PBMs opaque. With @annawmathews: wsj.com/health/healthcare/dr…

𝐅𝐞𝐝𝐞𝐫𝐚𝐥 𝐀𝐩𝐩𝐞𝐚𝐥𝐬 𝐂𝐨𝐮𝐫𝐭 𝐄𝐱𝐩𝐫𝐞𝐬𝐬𝐞𝐬 𝐒𝐤𝐞𝐩𝐭𝐢𝐜𝐢𝐬𝐦 𝐓𝐨𝐰𝐚𝐫𝐝 𝐏𝐁𝐌 𝐀𝐫𝐠𝐮𝐦𝐞𝐧𝐭𝐬 𝐢𝐧 𝐓𝐡𝐞𝐢𝐫 𝐂𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞 𝐭𝐨 𝐀𝐫𝐤𝐚𝐧𝐬𝐚𝐬 𝐋𝐚𝐰 𝐁𝐚𝐧𝐧𝐢𝐧𝐠 𝐏𝐁𝐌𝐬 𝐟𝐫𝐨𝐦 𝐎𝐰𝐧𝐢𝐧𝐠 𝐏𝐡𝐚𝐫𝐦𝐚𝐜𝐢𝐞𝐬 Today, the U.S. 8th Circuit Court of Appeals heard arguments on the constitutionality of Arkansas Act 624, a first-of-its-kind law which prohibits pharmacy benefit managers (PBMs) from directly or indirectly owning, operating, or holding retail and mail-order pharmacy permits within Arkansas. The law has been put on hold while PBMs challenge its constitutionality. The Court of Appeals will decide whether the law must remain on hold as the underlying legal challenge is heard in the trial court. The PBMs argue Act 624 discriminatorily blocks out-of-state entities from participating in the state's pharmacy market. During oral argument, the judges expressed skepticism toward the PBMs’ position. The judges obtained the PBM attorney’s acknowledgment that Act 624 would prohibit all vertical integration, whether the PBM is based out of Arkansas or in Arkansas, thereby directly undermining the PBMs’ primary argument. The judges also were concerned that accepting the PBMs’ argument would hamper state antitrust enforcement more generally. Arkansas’s attorney made clear that Act 624 applied equally to in-state and out-of-state PBMs and therefore did not violate the U.S. Constitution’s Dormant Commerce Clause and effectively addressed all of the PBMs’ discussion points, even noting that the PBMs were relying on statements from a single legislator in a podcast to argue discriminatory intent. A decision by the Court of Appeals is expected within months.

Thank you, @AGLizMurrill and the Louisiana Department of Justice for taking action against Express Scripts and Ascent Health Services, for the unlawful practices that manipulate pharmacy reimbursement, restrict competition, and steer patients toward PBM-affiliated pharmacies👏 LIPA extends its sincerest gratitude to the Attorney General’s Office for its attentiveness to the challenges facing independent pharmacies and its commitment to protecting patients, pharmacy access, and a fair prescription drug marketplace. #lagov #pbm
🚨Breaking: Louisiana sues Express Scripts and Ascent over scheme to drive up drug costs, squeeze independent pharmacies, and limit patient choice.

As he put it, one of the most important connections in healthcare is those “last five feet” when the pharmacist is face-to-face with the patient, providing guidance about their medications. His comments came during a discussion focused on some of the biggest questions facing healthcare today: how we lower healthcare costs through better delivery and financing models, encourage innovative health plans without sacrificing access, help small and mid-size employers afford coverage, and give consumers better information about healthcare cost and quality. That is exactly where community pharmacy belongs in the conversation. 🏘️ A meaningful professional dispensing fee isn't simply another healthcare expense. It is an investment in access, prevention, medication safety, and keeping healthcare available in the communities that need it. 👏 Thank you, Mark Cuban, for recognizing that losing the local pharmacy ultimately costs communities far more than paying pharmacies fairly to keep their doors open. Thank you Chairman Frank for exploring paths for affordable and effective healthcare for all Texans! Watch and Listen: aprx-public-static-assets.s3…

Many look at the number of PBMs in the market and assume it’s competitive because they can see all the distinct logos of the different PBM companies. But when it comes to actual PBM functions, the competitive landscape is far less rigorous than the logos would otherwise make it seem. For example, one might look at two larger PBMs like Prime Therapeutics and Express Scripts and say they are competitors. Don’t let the different logos fool you. They’re actually working together. That’s not competition. That’s co-opetition. floridapolitics.com/archives… @EricJohnLarson @AGJamesUthmeier @JamesUthmeierFL

I 💯 agree 👏 👏. Thank you Sen @TomCottonAR and and Sen @SenTimKaine for putting our nation’s finest men and women first over PBMs in the Tricare pharmacy program with your introduction of the Rx Access Act today in the U.S. Senate. #PBMReform @arkpharm @AGTimGriffin
I applaud @SenTomCotton for standing up for uniformed service members, retirees, and their families by ensuring that they have access to prescription drugs at pharmacies of their choice. The Rx ACCESS Act, which Senator Cotton has co-sponsored, would require pharmacy benefit managers (PBMs) to reimburse pharmacies participating in the TRICARE program either the actual cost of a drug or the national average drug acquisition cost, thus shielding independent pharmacies from unfair reimbursement practices and empowering military members and their families to use the pharmacy they choose—not the one chosen for them by the PBMs. As an almost 30-year Army officer, my family and I have seen firsthand the anti-competitive ways PBMs manipulate the market and burden servicemembers. For far too long, PBMs have abused their power to the detriment of consumers and independent pharmacies to benefit themselves. We are addressing this at the state level, and I am pleased to see legislation introduced in Congress to address it nationally. tinyurl.com/mwdkk84f #arnews

Today, the Trump-Vance @FTC reached a historic settlement with one of the nation’s largest pharmacy benefit managers, Cigna/Express Scripts. A lot of Americans probably aren’t familiar with PBMs, who are middlemen in our complicated healthcare markets. But I know you’re tired of high drug costs.

🚨Today’s deal announced by the FTC is a direct result of the House Oversight Committee’s investigation that has exposed PBMs’ anticompetitive tactics driving up the cost of prescription drug prices for Americans and jeopardizing patient care. Our investigation, which culminated in a report with our findings and recommendations, found PBMs have largely operated in the dark and abused their position as middlemen to line their own pockets by passing on costs to patients. These self-benefitting tactics raise prescription drug prices, like insulin, harm Americans who need access to life-saving medication, and undermine community pharmacies. I applaud the Trump Administration for their action to drive down prescription drug prices for Americans. The House Oversight Committee will continue to do its part to ensure Americans have access to affordable medication.

Passage of these bills is GOOD for our country and GREAT for Arkansas. We secured huge wins for rural + maternal and infant health care, workforce development, transportation infrastructure & national security operations in The Natural State that will directly benefit Arkansans.
