Three weeks ago, @JaneAFlegal and I wrote a piece for the WSJ outlining the reforms that should be in a permitting deal and the urgency of passage this Congress, especially for Dems. The Bipartisan American Affordability and Jobs Act of 2026 meets the moment.

If you recall I warned everyone not to ask climate people about permitting reform. But nobody listened, so I conjured up a whole thanksgiving meal analogy about BAAJA and climate progress that my colleagues are mercifully showing you only a small part of here
If climate policy is a Thanksgiving dinner, the #BAAJA bill is the mashed potatoes, cornbread, and pumpkin pie. 🦃

Pass permitting reform!
The Trump administration‘s recent actions reinforce how crucial it is that permitting reform legislation provides protection and certainty for permitted projects. Undermining permitted projects will raise costs for RIers and consumers across the region.

This is not true. The exceptions for 1401 that allow a permit to be pulled include: a court order, a material breach or other violation of law, fraud, urgent harm shown by new information, and a request from the permit holder. Courts can still absolutely undo an illegal permit.
SCOOP: Former Biden senior climate advisor John Podesta said senators should renegotiate the bipartisan permitting deal & he believes the bill’s permit certainty language hands Trump a “loaded Howitzer” to go after public lands.

BAAJA will deliver good-paying union jobs and lower electricity costs for American families.

Key paragraph: "Oil industry leaders have urged the Trump administration against a wholesale repeal of methane mandates in favor of more modest recalibrations, arguing the Biden-era requirements at times were technologically infeasible, inefficient and costly." Industry associations mostly wanted targeted fixes, as reflected in their public comments.
SCOOP: President Trump is set to unveil a plan to dial back methane mandates on oil & gas operations during a Texas rally Tuesday. He's expected to cast the proposal as a way to encourage more domestic energy production & lower costs. bloomberg.com/news/articles/… w/ @Zhirji28

“I’ve spent years and a good deal of my own money fighting for climate action, and I’m not in the habit of praising anything Republicans have endorsed. So I’ll say it plainly to my fellow progressives: this is a bill we should support, and I’m asking you to join me.”

“The timing is right.” Natural Resources Chairman @RepWesterman joins @ThomasHochman and @ppavnr on Right of Way to break down the Senate’s permitting deal and why passing the Bipartisan American Affordability and Jobs Act is critical.

What is the counterfactual here
Scoop in @PunchbowlNews AM: 4 Senate Democrats led by @SenDuckworth are pushing back on the bipartisan permitting reform bill, arguing it will further enable Trump to favor fossil fuel projects and won’t stop its attacks on clean energy. Merkley, Markey, Wyden join new letter

Like many in tax world, I’ve been dismayed at how bipartisan the tax revolt has become. Exempting more people and income from taxes. How do we combat these bad ideas? Fund the tax police again to restore credibility. My guest piece for @SearchlightInst. open.substack.com/pub/search…
The first line of this video may seem familiar: “A new permitting bill could let the Trump administration build a coal plant in the Grand Canyon.” This is a completely specious, astroturfed attack. Don’t take my word for it, here’s a transcript of their strategy call!
As you might suspect, BAAJA doesn’t allow this or any other President to build a data center in the Grand Canyon. Because that’s illegal.

Leaders from Democratic and Republican presidential administrations are calling on Congress to pass BAAJA. This bill is the best proposal we’ve ever had to fix our broken permitting system, fight climate change, lower costs, create jobs, and keep data center costs off of our electricity bills. This letter is an encouraging sign. A 🧵
