So, all Evans had to do was pick an unfalsifiable allegation, that could not technically be ruled out, and it became the incontrovertible mechanism of murder. Goss didn’t understand Evans had to disprove all other mechanisms to make this claim.

The more i learn about the Lucy Letby investigation and trial where the nurse was convicted of murdering 7 babies and the attempted murder of 7 others in neonatal care, the more horrified I become.

The Lucy Letby miscarriage of justice could well be the final straw that sees an overhaul of the English justice system. Nobody should go to jail because the prosecution had a better story than the defence. When did convictions based on zero evidence become acceptable? It can't be allowed to continue like this.

"scary dichotomy"
The worst is that the court accepted Evans changes of heart in his evidence, accepted preposterous inventions such as the Condolences card as evidence of murder.
Yet the tiniest apparent deviation from some golden perfection by Letby is pounced on. It's mad.

A quite scary dichotomy in the way the accusers' gut feelings appeared to have been accepted almost on trust, while there was, where the defendant was concerned, something alarmingly close to a preconception of guilt.
Evident from the start in the cherry-picking way that part only of Letby's jottings were read so as to be presented as a confession.

Evans’ diagnosis of exclusion! He didn’t make a positive diagnosis of air embolus, but said it was air embolus by excluding other conditions then firmed up with any description of discolouration Jayaram and Co came up with!
Great way to send innocent Lucy Letby to prison for life.

Outstanding from Stephen Phelps:
The Court of Appeal is uninterested in justice. It is almost exclusively concerned with whether or not process was followed.

Another great video from Chris. It’s great to hear from a KC, Noel Magee, who breaks down why the prosecution’s “elimination” argument in Lucy Letby’s trial fails legally: simply put, if you are going to claim murder by ruling out alternative causes of death, you have to actually investigate and rule out ALL plausible causes!
There is no way this can be claimed in this case. The obstetric notes, maternal health, and birth complications were barely part of the prosecution case, and the maternity notes were denied to the defence. Dewi Evans wasn’t even fully aware of the Pseudomonas infection, and he didn’t really consider the substandard unit conditions in his hypothesis. Significantly, Judge Goss stated at the start of the trial that exogenous insulin had been administered when, in fact, this was far from established.
Magee argues that failing to even address, let alone eliminate, more obvious and likely explanations simply leaves the case unproven and unsafe.

In theory the police investigation is neutral. We know however that this is far from true. Quite apart from failure to pursue all lines of inquiry, the judge in Letby simply blocked inconvenient evidence held by the police. e.g. Obstetric notes. Similar in Post Off. Scandal too.

The LUCY LETBY case is high profile in many countries & it's exposure of the shameful state of British "Justice" is unprecedented. This case would NOT even have made the starting blocks in the USA! The "Evidence" was a joke @JoshuaRozenberg @dshensmith

Third, the bench permitted unverified lab screens as definitive proof of insulin poisoning. Goss allowed commercial immunoassays, explicitly barred by manufacturers for forensic use..without the mandatory mass spectrometry confirmation required to rule out false positives.

Second, Goss failed his gatekeeping duty by ignoring a higher bench. Lord Justice Peter Jackson had already ruled lead expert Dr Evans’ work "tendentious" & "partisan." A lower court cannot delegate a binding finding of expert unreliability to a lay jury.

The Letby convictions face growing scrutiny over 3 major judicial failures by Mr Justice Goss. First, the trial bypassed R v Cannings: letting a prosecution proceed based on retrospective paper theories when the original, objective post-mortems found no criminality.
